5.1. The State Patent Collection

The State Patent Collection (hereinafter referred to as the «SPC») is a set of information resources stored on any media, systematized and provided with a complex of indices and reference aids maintained in respect to all industrial property rights including registered computer programs, databases and topographies of integrated circuits, which comprises patent documents and literature, publications related to the patent law, normative and methodological literature, and other scientific and technical publications for reference purposes.

The SPC is currently presented in both tangible (collections on paper, microforms, and optical disks) and electronic forms (modern automated patent information system PatSearch, currently being the most important and rapidly developing element of the SPC). The functionality of this system intended primarily for organizing the work of the patent examiners. The system can be used (with some restrictions) by all categories of the users in the display room of the Patent Library (VPTB) (access to national applications and database Derwent World Patent Index of Thomson Reuters company was not provided).

In 2015, the SPC was customarily updated with national and foreign patent documents within the international exchange activities and under the special bilateral agreements with the Patent Offices of 57 countries, 5 international organizations and the Institute of Foreign and International Patent, Copyright and Competition Law named after M. Planck (Germany).

The international exchange of patent documentation was carried out mainly by uploading the data of foreign patent Offices on the basis of specific bilateral agreements or written notices in relation thereto, on the free of charge basis. Part of the documentation is supplied on a tangible media (optical disks). Rospatent fulfilling its obligations on the international exchange uploaded its official publications through a special FTP-server to allow foreign patent offices the unloading of documents due to the provided to them personal login and password.

The structure of the international exchange of patent documentation with the foreign patent offices is illustrated by data shown in Table 5.1.1.

In 2015, the SPC acquisition documentation was received from the patent offices on the optical disk (CD-and / or DVD-ROM) or uploaded in the PatSearch system from the official websites or special network resources of patent offices in batch mode (countries of the PCT minimum documentation) or was included in the SPC on disks. Current national patent documentation was also included in the PatSearch system.

Well-known abstract information of the global patent collection Derwent World Patents Index (DWPI) published by the company Thomson Reuters (Professional) UK Ltd. is also loaded to PatSearch system within the framework of the contract for the provision to FIPS updates of database for the period from 2014 to 2016.

The FIPS Patent Library (VPTB), when processing acquisition and maintenance of the SPC, is continuously monitoring completeness thereof, incoming records and discharged foreign documentation, as well as quantitative status of the SPC as a whole.

The quantitative characteristics of the SPC showing the dynamics of the receipt of the patent documents for last four years are presented in Table 5.1.2.

In 2015, as before, the following key challenges in respect to the SPS functioning were met:

  • ensuring the patent information contents of the PatSearch system: preparation and uploading of the foreign patent documentation from optical disks, web sites of foreign Patent Offices and the FTP servers to the PatSearch, review of the completeness and authenticity of the patent collections, organization of work on reconciliation and addressing gaps, interaction with the foreign patent offices aimed at solving problems in receipt of the documents in FTP mode for further uploading of data in the PatSearch system;
  • enhancing the SPC structure with the view of reducing its volume on paper by eliminating the duplicates on the results of the auditing of the collections on a different types of media;
  • improving the SPC comprehensiveness via integration of the non-patent literature and obtaining the access to the electronic versions of scientific and technical publications and databases as well as patent literature in order to enhance information support of the users.

The SPC is customarily divided in two main parts — the Central Patent Collection (CPC) and the State Patent Examination Collection (SPEC). These collections are arranged as independent collections of patent documents; they have different aims and are featured by specifics in respect of acquisitions and structure thereof.

5.2. The Central Patent Collection (CPC)

The Central Patent Collection (CPC) is created for all the categories of users of patent information and comprises the collections of national patent documents (since 1814), foreign patent documents of various countries with different retrospective, abstracts and bibliographic data publications relating to all the titles of industrial property, patent law related literature, normative acts and various reference information as well as reference and search aids to the said collections.

As on January 1, 2016, the CPC amounted more than 106,4 million copies of patent documents of all kinds stored on different types of media.

In 2015, the CPC was updated with over 3,0 million copies of national and foreign patent documents on CD / DV-ROMs uploaded from the FTP servers.

For the purposes of conducting the patent and information researches, the VPTB provides for all categories of the users an access to search engine PatSearch along with other modern patent information products, such as DB EPO Global Patent Index (GPI), EAPATIS and digital libraries of scientific literature E-Library.

The SPC contains as its integral part the patent-law and dictionary-reference literature collections amounting to approximately 89.7 thousand publications. Users are provided with an access to the full-text legal databases as well as electronic and book patent-law publications of publisher Kluwer Law and Business, Edward Elgar and others.

5.3. The State Patent Examination Collection (SPEC)

Another key element of the SPC is the SPEC, being designed to support the state patent examiners on intellectual property.

The composition and content of the SPEC are subject to Rule 34 of the Regulations under the Patent Cooperation Treaty (PCT), to which Rospatent is a party, and determined also by intergovernmental treaties and agreements with the other Offices.

The SPEC is also represented by the domestic automated search system PatSearch that is regularly completed with both national and foreign patent documentation.

The key element of the SPEC is abstract database DWPI.

As previously, in 2015, for the purpose of the state examination performance, an access to the STN International, the world’s leading online service for research and patent information in science and technology, and the EPO’s information retrieval service EPOQUE Net was provided.

As on January 1, 2016, the SPEC part contains more than 17,2 million of patent documents of the former USSR, Russia, the USA, Britain, France, Germany, Switzerland, Australia, Austria, Canada, the Eurasian Patent Organization and the CIS countries maintained on paper. Collections of domestic and foreign patent documents on paper are arranged according to the IPC.

In 2015, the SPEC on paper was increased only with national patent documents, totally for this year 48.5 thousand domestic documents were received.

The needs of the state examination in non-patent literature was satisfied by the completion of the SPEC by patent and legal, scientific and technical, dictionary and reference, technical publications and other periodicals, as well as due to separate requests via interlibrary exchange and electronic delivery of documents from the collections of the largest specialized libraries of Moscow and remote databases.

5.4. Official and Informational Publications of Rospatent

In 2015, all Official Bulletins of Rospatent were published in the section «Official Publications» on the FIPS website in free access.

In 2015, on the FIPS website the following Official Bulletins were published:

  • «Inventions. Utility Models» (with specifications of Inventions) — 36 issues (disks);
  • «Trademarks. Service Marks. Appellations of Origins» — 24 issues (disks);
  • «Industrial Designs» — 12 issues (disks);
  • «Computer programs. Databases. Topographies of integrated circuits» — 12 issues (disks).

In 2015, the following information was published in the Official Bulletins:

  • 60 438 announcements on Inventions, including 25 573 RU patent claims to applications for patent, 34 712 claims to applications for patent of the Russian Federation, 153 claims to author’s certificates and patents of the former-USSR, which were not published before;
  • 9014 Utility Model claims;
  • 5493 announcements on Industrial Design Patents;
  • 30573 announcements on Trademark registrations;
  • 16 announcements on the registration of Appellations of Origin;
  • 33 announcements on granting a Certificate to the right to use of Appellation of Origin;
  • 13410 annotation on Computer Programs;
  • 1804 annotation on Databases;
  • 139 annotation on Topographies of Integrated Circuits.

In the reporting year, Rospatent continued the publication of data on the submitted applications for trademarks and appellations of origin in the official bulletin «Trademarks, Service Marks and Appellations of Origin». 44215 data on the submitted applications for trademarks and 50 data on the submitted applications for appellations of origin were published.

In the reporting year, the official bulletins of Rospatent included totally about 165 185 publications concerning registered intellectual property rights and filed applications for inventions, trademarks and appellations of origin that was for 28.3 % more than in 2014. This increase in the number of publications occurred mainly due to the publication of information on the submitted trademark applications filed after October 1, 2014, carried out in accordance with the amended article 1493 of the Civil Code of the Russian Federation.

In 2015, 34712 specifications to patents of the Russian Federation, 9014 front pages of utility models descriptions to patents of the Russian Federation, 104 specifications of inventions related to declassified author’s certificates of the USSR were published in the official bulletin «Inventions. Utility Models».

The titles of protection were prepared and sent to the holders of the all rights of intellectual property.

An important achievement of 2015 was the reduction of the period from the registration date of the invention in the electronic state register of Inventions before the date of publication of data on granting of a patent for the invention including the description of the invention in the Official Bulletin «Inventions. Utility Models». By the end of 2015 the average period from the registration date of the invention before the date of publication in the Official Bulletin decreased for 20 days and was equal to 1 month (in 2014 that period decreased in comparison with 2013 from 2.5 months to 1 month and 20 days). For the other objects of intellectual property that period was approximately 1 month and 10 days. The FIPS specialists continued work related to further reduction of the term.

The introduction in 2014 of electronic state registers of inventions, utility models, industrial designs as well as electronic registers of computer programs, databases, topographies of integrated circuits made it possible in 2015 to begin work on improving the system of information publication on the registered intellectual property rights as a system of information user service. In August 2015, operational testing of a new publishing system was launched which revealed a number of problems of technical and technological character the solution of which is necessary for the successful completion and implementation of the system into operation in 2016.

A new system of publication being developed will allow publishing information on the intellectual property rights to be entered into the electronic state registers in the Official Bulletins of Rospatent posted on the FIPS website as soon as possible after entering this information into the electronic state registers.

In addition, in 2015, the following classifications were published and posted on the official website: International Patent Classification, Revision 2015.01 (IPC 2015.01); International Classification for Industrial Designs (ICID, 10 edition); International Classification of Goods and Services for the Registration of Marks (10th edition), ICGS 2015 version (10-2015), as well as Annual Report 2014 of Rospatent.

In 2015, FIPS prepared and published paper edition «Additions and amendments to ICGS (ICGS-10) version 2015 ICGS (10-2015).

5.5. Supply of Information Services

Patent and information support of Rospatent specialists, organizations subordinated to Rospatent as well as all other interested users of patent information is performed on the basis of the SPC directly in VPTB (information desks), or as in the mode of remote access, in particular, by providing information and telephone consultations, fulfilling written requests and posting of various information products prepared by VPTB on the FIPS website.

Table 5.5.1 shows key indicators of information services provided by the Patent Library on the basis of the SPC for the last five years.

In 2015, more than 3, 0 thousand requests made by the readers of VPTB FIPS and remote regional and foreign users for the following patent information services were executed: conducting patent and information search; performing factual inquiries; provision of certified copies of patent documents. Most the requests were related to search for patent documents of particular individual and legal persons.

The FIPS website Section «VPTB» provides an access for users of patent information as to variety of patent information products and other materials prepared by employees of VPTB, actualization and updating of the materials is being carried out on the permanent basis.

In 2015, additions and amendments were done in the following information resources: «The Guide to the collections of VPTB and Internet resources» was added with the information on the intellectual property rights and means of individualization databases, «Internet browser on patent information resources» was added with the information on the CIS countries, the recommended bibliography lists for regions are posted monthly, electronic catalog of patent and legal literature was updated; translations of the EPO publication «News of patent information» were prepared and posted. There was published information in the following sections: «Thematic meetings», «Bibliographic indexes and references», «New Arrivals», «Contacts», «Information for Users», etc.

Glossary of terms in the field of intellectual property in the section «For Beginners» was updated. Additional references to section «Patent Library VPTB» and information resources of VPTB on the FIPS website in section «TISC», «Information resources», «References» were developed.

The requests of users to the information products of VPTB posted on the FIPS website are illustrated by data given in Table 5.5.2.

In 2015, on the basis of the Electronic Catalogue and other sources of information VPTB prepared bibliographic and information materials for the participants of the events organized by Rospatent.

For the participants of the IV meeting of TISC VPTB prepared the bibliographic indexes «Legal protection of intellectual property results and means of individualization in accordance with the Civil Code of the Russian Federation» and «Carrying out of patent search using information search systems».

For thematic meetings with the leading examiners of the FIPS and Rospatent were prepared the following bibliographic indexes:

«Carrying out of patent search using information search systems»; «Preparation of the industrial design application considering changes made to Part IV of the Civil Code of the Russian Federation»; «New patent law (including changes made to Part IV of the Civil Code of the Russian Federation in 2014)»; «Commercialization of results of intellectual activity»; «Electronic filing of applications for industrial property rights in the Russian Federation in the framework of international and regional agreements: national and foreign publications».

Brochure «The emergence and development of legislation on the protection of means of individualization in the Russian Empire (from marks to trademarks)» was prepared which dealt with the practice of registration of trade marks in the Russian Empire in 1896–1917.

VPTB provides services for Rospatent specialists in the mode of the Selective Dissemination of Information (SDI). SDI system allows the users to receive alarm information on publications relating to various aspects of legal protection of intellectual property rights all over the world. 104 participants of the system were registered as of December 2015. Throughout 2015, they received 207.4 thousand units of information. Besides, bibliographic reference lists of literature and other materials were prepared at the individual requests of leadership and employees of Rospatent and FIPS.

A significant part of the users of SPC are students of different Universities. In 2015, the department VPTB organized for them 30 visits and workshops related to work with patent documentation which was attended by 392 persons. Along with the Universities that have already for several years participated in such events (RGAIS, the Moscow Institute of Steel and Alloys (MISiS), the Bauman Moscow State Technical University (BMSTU), the Plekhanov Russian University of Economics, etc.), in 2015, such visits were originated for students of the Russian Peoples’ Friendship University (University), Faculty of Fundamental Physics and Chemical Engineering of the Moscow State University (MSU) and the Polytechnic College № 8.

Department VPTB organizes thematic meetings with the heads and leading specialists of Rospatent and FIPS for applicants, right holders, patent attorneys, patent engineers, scientists, representatives of the business community and other people interested in issues of intellectual property protection. The participants of the meetings have the opportunity to ask the speakers the questions, suggest new topics for reports.

In 2015, 9 thematic meetings were organized, during which the leading examiners of the FIPS made their presentations and for the first time the specialists of the RGAIS made their reports.

The meetings were devoted to issues of information search conducting in databases of Rospatent and EPO, filing of applications for industrial designs, consideration by the Chamber of Patent Disputes of objections and requests via using the video conferencing systems, training to work with the e-filing system for inventions, utility models, trademarks, issues of commercialization of intellectual property. A special place was given to the meeting held in the framework of intellectual property events to celebrate the 55th anniversary of the FIPS establishment and dedicated to the practical application of the new legislation in the field of intellectual property.

The meeting was attended by 1226 people from Moscow and the Moscow region and other Russian cities: Buy, Vladimir, Volgograd, Voronezh, Kostroma, Obninsk, Nevel, Nizhny Novgorod, Omsk, Ryazan, St. Petersburg, Saratov, Tver, Tomsk, Tula, Yaroslavl. Interested users from Barnaul, Belgorod, Voronezh, Novosibirsk, Rostov-on-Don, St. Petersburg, Saratov, Khanty-Mansiysk — amounted to 274 participants based on the 9 regional TISC’s took part at the meetings in the mode of video conferencing. For the first time the TISC based on the Saint Petersburg State Polytechnic University named after Peter the Great participated in the videoconference.

The activity of the Rospatent Museum is aimed at patriotic education, promotion and popularization of knowledge on intellectual property. In 2015, the main exhibition of the Museum was updated; 13 thematic exhibitions dealing with current events in the world of intellectual property, anniversaries and memorial dates including the 60th anniversary of Rospatent and the 55th anniversary of FIPS were organized. Work on the development of a new form of museum exposition activity, namely organization of combined thematic exhibitions including exhibit items and photographs of FIPS employees was continued. In 2015, four of such expositions were organized. The exhibition of book editions and art books of the museum was a great success dedicated to the announced in 2015 Year of Literature. Within the Open Day for the children of the FIPS some excursions were held in which 87 people participated.

In 2015, the Museum was visited by experts of the European Patent Office and the Office for Harmonization in the Internal Market (OHIM), patent offices of Armenia, Kazakhstan, the Republic of Korea, participants of the Science and Practice Conferences of Rospatent, employees of Rospatent and FIPS, users of VPTB — amounted to 1493 participants.

In 2015, patent information users had access to different information products, including the official publications of Rospatent and FIPS and prepared on the basis of official publications. The basis of the products was a system of electronic publications that integrated all kinds of official publications on the same platform of means of search and access to patent documents.

Along with publication of the official editions of Rospatent on the website of FIPS in section «Official Publications» bulletins on industrial property objects on CD and DVD characterized by a compact storage of large volumes of information, the possibility of all types of patent search using advanced information retrieval system MIMOSA was continued, 285 annual sets of such publications were purchased by users in 2015 (see Table 5.5.3).

A wide range of information products on optical disks included also the official Russian publications of international classifications of industrial property objects in the Russian language with the search systems that provide opportunities for profound search of patent documents. In 2015, the subscribers were offered on CD a new edition of the International Patent Classification — IPC-2015.01 together with the alphabetical subject index. Also, in 2015, amendments to the 10th edition of the International Classification of Goods and Services — (IPC -10) effective from January 1, 2015 were issued.

Quick access to the accumulated array of Inventions on CD and DVD provides a quarterly search and reference unit (SPA) on DVD containing abstract information with links to full-text specifications posted on the FIPS web site in the Internet (Table 5.5.3). In 2015, alongside with subscription of this edition, copying and delivering thereof was carried out in 135 Technology and Innovation Support Centers (TISC) of the Russian Federation over the last years.

In 2015, production on optical disks of arrays of retrospective patent information was continued: sets of descriptions of Inventions (since 1924), sets of descriptions of Utility Models (since 1994), sets of information on Industrial Designs (since 1993), sets of information on Trademarks (since 1991). In 2015, over 98 of such sets were spread totally (see Table 5.5.3).

The total number of subscribers to information editions produced on optical disks and on paper tended to decrease over the past years (see. Table. 5.5.4) due to the refocusing of a significant part of users to obtain the information in the Internet and other online systems.

However, organizations and enterprises engaged in innovation activities (scientific, industrial, and educational) remained stable users of information products. In 2015, active end users of the patent information products were the information services, offering customer service in the Russian regions, which was caused by the development of TISC network in the Russian Federation (see Table 5.5.5)

Distribution of the subscribers of the Russian Federation by regions is presented in Appendix 4. Still, the most active geographical segments were the Central (39 %) and Volga (24 %) federal districts.

In 2015, Rospatent and FIPS provided on their websites in the Internet an access to a wide range of databases, including electronic publications (see section 4.2 of the Report).

The content and structure of the website presenting the activity of Rospatent within the framework of its competence (www.rupto.ru) reflect the most important issues of development of intellectual property protection system in Russia.

Press releases about events related to the activities of Rospatent as well as events in the intellectual property protection system were published regularly. In 2015, publications of legal acts were carried out as well as «Report of Rospatent 2014» was published in the Russian and English versions. To increase the activity of use of electronic services section «Leaders of electronic filing of applications» was opened.

In accordance with the Open principles sections «State procurement», «Fees», «Anti-corruption», «Commission of Rospatent regarding compliance with the requirements of the conduct of government officials and conflict of interest management», «Control and supervision in the sphere of legal protection and use of RIA created by federal budget allocations» were updated.

New heading «Traditional and regional foreign patenting procedure» was created. Further development got headings «Small and medium-sized enterprises on protection and use of results of intellectual activity», «GPPH».

In section «Open Data» were published 10 sets of data in a format that ensures their automated processing to reuse without advanced change by a person (a computer-readable format) and on the terms of its free use, provided for a new form of services of visitors of Rospatent website section.

In 2015, simultaneously with Rospatent website, FIPS website (www.fips.ru) worked actively, which was aimed at the comprehensive customer support at various stages of the legal protection of intellectual property.

The structure of the section «Electronic interaction with applicants» had been constantly updated with the information for users of the service system associated with filing of applications in electronic form.

In the «Patent Information Products» published materials orienting users in the effective use of information products offered for searching and analyzing patent information.

On the FIPS website in section «Department «All-Russian Patent and Technical Library (VPTB)» regularly were updated sections «Thematic meetings», «Internet browser on patent information resources», «Guide to the collections of VPTB and Internet resources», «Bibliographic indexes and lists», «Recommendations on the list of necessary methodological, legal, patent literature, documentation for patent departments and services of public research and education sector and organizations that form the national nanotechnology network», translation of the EPO edition «patent information news» into the Russian language.

As on November 11, 2015 in section «Technology and Innovation Support Centers (TISC)» was published the Guide of TISC that provided a list of services provided by that centers.

In 2015, the maintenance and development of patent document collections and provision of information services to users based mainly on the new information technologies with special secure channels of data transfer and provision of information in the remote access was provided, terms of information publication on granting patents for inventions were reduced, the number of patent documents provided to users of patent information was increased.
