5.1. The State Patent Collection

The State Patent Collection (hereinafter referred to as the “SPC”) is a totality of information resources stored on any media, systematized and provided with a complex of indices and reference aids, which relate to all industrial property rights including registered computer programs, databases and topographies of integrated circuits and comprises patent documents, patent associated literature, patent law related publications, normative and methodological literature and other scientific and technical publications for reference purposes.

SPC are now presented both at tangible media (collections on paper, microform, and optical disk) and in electronic form - modern automated patent information system PatSearch, currently being the most important and rapidly developing element of the SPC. The functionality of this system intended primarily for organizing the work of the patent examiners, and in the display room of the Patent Library (VPTB) this system can be used (with some restrictions) by all categories of the users.

In 2013 the SPC was updated with national patent documents as well as foreign patent documents under traditional international exchange and special bilateral agreements with the Patent Offices of 57 countries and six international organizations.

The modern forms of providing information to the users are changing the kinds of international exchange, and therefore the types of acquisition and maintenance of the SPC. One of the main problems of the Federal Institute of Industrial Property (FIPS) in the transformation of traditional system of international exchange of patent information is to preserve the principle of international exchange of data which are traditionally free, but not on a commercial basis.

International exchange of patent documents is taking place now both on traditional carriers of information as well as by uploading in accordance with new bilateral agreements or written notices related to exchange of data.

The structure of the international exchange of patent documents with foreign Patent Offices is illustrated by data shown in Table 5.1.1.

Documentation for the acquisition of the SPC in 2013 came from the patent offices on the optical disk (CD-and / or DVD-ROM) or unloaded in PatSearch system from the official websites or special network resources of patent offices in batch mode.

All retrospective sets of national and foreign patent documentation of countries of the PCT minimum documentation, which are available in the SPC on machine-readable media, are uploaded in the PatSearch system, as well as the current national and foreign documentation on optical disks and documentation uploaded from the sites of the foreign Patent Offices.

Well known abstract information of the global patent collection, preparing by the Thomson Reuters is also loaded to PatSearch system. At the end of 2013 an Agreement was signed with the company Thomson Reuters (Professional) UK Ltd. granting to FIPS an access to DWPI updated database for the period from 2014 to 2016, inclusive.

Following the general trend of the submission of patent documents on network resources, FIPS, starting from January 1, 2014, changes the way of data transmission within the framework of international exchange: it stops sending the official publications on disk and begins to publish official publications of Rospatent on the official website of FIPS. Foreign patent offices, which are the international exchange partners, received the usernames and passwords for access to special FTP-server of FIPS.

Patent Library (VPTB) of the FIPS when processing acquisition and maintenance of the SPC is continuously monitoring its completeness, records incoming and discharged foreign documentation and quantitative status of the SPC as a whole.

The quantitative characteristics of the SPC showing the dynamics of the receipt of patent documents for last four years are given in Table 5.1.2.

In 2013 the most important issues relating to functioning of the SPC were as follows:

  • Implementation of new functionalities of automated information and technological systems used for compiling and maintenance of the SPC for all the categories of users;
  • Enhancing the SPC structure with the view of reducing labor costs required for their use, including control of collection on traditional storage medium with the purpose of their withdrawal from the structure of the SPC;
  • Gathering of the statistics and the analysis of the quality control of multipurpose automated patent search system Patsearch, development of industrial technology for loading of foreign patent documentation from optical disks and sites of foreign Patent Offices to the Patsearch, interaction with the foreign patent offices aimed at solving of problems dealing with acquisition of the documents in FTP mode for further uploading of data in the system.

The SPC is traditionally divided in two main parts – the Central Patent Collection (CPC) and the State Patent Examination Collection (SPEC). These collections are organized as independent collections of patent documents with different tasks and some peculiarities inherent to their acquisitions and structure.

5.2. Central Patent Collection (CPC)

The Central Patent Collection (CPC) is created for all the categories of users of patent information and comprises a collection of national patent documents (since 1814), collection of foreign patent documents of various countries with different retrospective, collections of abstracts and bibliographic data publications relating to all the titles of industrial property, collections of patent law related literature, normative acts and various reference information as well as a set of Indices and other reference and search aids to these collections.

As of January 1, 2014, the CPC amounted more than 100,4 million copies of patent documents of all the kinds stored on different types of media.

In 2013 the CPC was updated with over 4,1 million copies of national and foreign patent documents on CD/DV-ROMs.

The collection of patent, law, dictionary and reference literature amounts about 86,6 thousand of publications, and the users have an access to full-text databases of law as well as to electronic patent and law libraries.

In 2013 the CPC was updated with the following new information products on optical disks, indicated in Table 5.2.

The total number of various databases included in the CPC amounted to 270; they are presented on 56, 1 thousand optical disks (CD-ROM, DVD-ROM, CD-R).

The CPC service is used for all the users without any restrictions.

To conduct patent and information research for all categories of the users VPTB provides an access to search engine PatSearch along with other modern patent information products: DB EPO Global Patent Index (GPI), EAPATIS, digital libraries of scientific literature E-Library, Scopus, a database legal information publisher Kluwer Law and Business, etc.

5.3. The State Patent Examination Collection (SPEC)

Another important part of the SPC is the State Patent Collection, which is designed to serve the state patent examiners and presented in such a modern search tools as an automated search engine PatSearch, regularly updated by both domestic and foreign patent documents by downloading data from the specific network resources in FTP mode and optical disks. An important part of the system is regularly replenished abstracts database DWPI.

The State Patent Examination Collection (SPEC) is also represented domestic automated patent information database and patent collection on paper.

The composition and content of the SPEC is regulated by Rule 34 of the Regulations under the Patent Cooperation Treaty (PCT), to which Rospatent is a party, and determined also by bilateral treaties and agreements with other Offices.

In 2013, for the state examination, as previously an access to STN International - the world’s leading online service for research and patent information in science and technology, as well as information retrieval service EPOQUE Net of the European Patent Organization was available.

As of January 1, 2014, the SPEC on paper contains more than 17 million patent documents of the former USSR, Russia, the USA, Britain, France, Germany, Switzerland, Australia, Austria, Canada, the Eurasian Patent Organization and the CIS countries. Collections of domestic and foreign patent documents on paper are according to the IPC.

In 2013 the SPEC on paper was added only by national patent documents for inventions and utility models, totally for this year 44.5 thousand domestic documents were received.

The needs of the state examination in non-patent literature was satisfied by the completion of the SPEC by patent, legal, scientific, technical, dictionary, reference, regulatory and other technical publications and periodicals, providing access to databases of the abstract (for example, database SCOPUS, publisher Elsevier), and (for individual request) via interlibrary exchange and electronic delivery of documents from the remote databases.

5.4. Official and Informational Publications of Rospatent

In 2013 Rospatent has continued publishing official bulletins on electronic media equipped with a search system:

  • «Inventions. Utility Models» (with specifications of Inventions) — 36 issues (disks);
  • «Trademarks. Service Marks. Appellations of Origin» — 24 issues (disks).
  • «Industrial Designs» - 12 issues (disks).
  • “Computer programs. Databases of topologies of integrated circuits”) — 4 issues (disks).

In the reporting year the transition from paper to electronic form of publication of the official gazette Rospatent «Computer Programs. Database. Topographies of Integrated Circuits» was implemented. In 2013 year 4 issues of the Bulletin on electronic media with search engine (4 discs) been prepared and issued. In addition, the FIPS examiners carried out a work related to transition, starting from January 2014, a monthly preparation training and issue of the Official Bulletin «Computer Programs. Database. Topographies of Integrated Circuits»

In 2013 the following information was published in the Official Bulletins:

  • 58633 announcements on Inventions, including 26720 RU patent claims to applications for patent, 31638 claims to applications for patent of the Russian Federation, 275 claims to inventor certificates and patents of the former-USSR, which were not published before;
  • 12655 Utility Model claims;
  • 3461 announcements on Industrial Design Patents;
  • 25312 announcements on Trademark registrations;
  • 7 announcements on the registration of Appellations of Origin;
  • 10 announcements on granting a Certificate to the right to use of Appellation of Origin;
  • 14014 announcements on Computer Programs;
  • 1808 announcements on Databases;
  • 207 announcements on Topographies of Integrated Circuits.

In the reporting year the official bulletins of Rospatent includes totally about 116107 publications concerning registered intellectual property rights and filed applications for invention.

In 2013 in the official bulletin «Inventions. Utility Models» were published: 31638 specifications to patents of the Russian Federation, 12655 the fist pages of specifications of utility models to patents of the Russian Federation, 14 specifications to the Inventor’s Certificate of the former USSR related to the declassified inventions.

The titles of protection were prepared and sent to the holders of the all objects of intellectual property.

During the year, the FIPS examiners performed works related to the preparation to practical implementation of the Rospatent Order (from September 10, 2013 № 112) «On approval of the Statute of the official publications of the Federal Service for Intellectual Property.»

Work on the creation of a new page of FIPS website «Official Publications», namely its design and content were implemented. The respective page of Rospatent portal was upgraded and had the interlink to the FIPS site.

These innovations are available for the visitors of sites from January 10, 2014 - the date of posting on the official bulletin Rospatent «Inventions. Utility models » № 1, 2014, thus the information published on this site is an official publication with all the legal consequences.

In 2013 the following publications FIPS paper: «Inventions (Applications)», «Inventions (Patents)», «Utility Models» (36 volumes); «Industrial Designs» (12 volumes; «Trademarks, Service Marks and Appellations of Origin «(24 volumes)»; «Information and notices published in the Official Bulletins «Inventions. Utility models» and «Industrial Designs» (36 volumes);» Information and notices published in the Official Bulletins «Trademarks, Service Marks and Appellations of Origin» (24 volumes), with data concerning volume of the corresponding Official Bulletins.

In addition, in 2013 were published: Information Retrieval System «International Patent Classification, Revision 2013.01 (IPC 2013.01) and alpha-index» on CD-ROM, International Classification of Goods and Services for the Registration of Marks (10th edition) ICGS 2013 version (10-2013) on CD-ROM, as well as Annual Report 2012 of Rospatent.

Starting from 2014, FIPS publications on paper, concerning information of the relevant official bulletin, has finished. It will be replaced by bulletins issued since 2005 on the discs CD / DVD which are quite familiar to the subscribers.

Over 2013 the FIPS staff implemented a large range of activities related to:

  • preparation for the publication of information about the registration of computer programs, data bases and topographies of integrated circuits at the workstation of the editor of a new automated system for registration of computer programs, databases and topographies of integrated circuits (hereinafter referred to as the AS DB CP) (since of 10.01.2013);
  • preparation for publication (since 01.04.2013) of information on patents for inventions and utility models at the workstation of the editor of automated information system of paperless electronic documentation for inventions and utility models (hereinafter referred to as the AS EA);
  • preparation for the publication (since 01.04.2013) of information on the state registration of trademark, appellation of origin and granting exclusive rights to appellation of origin on the new workstation of the editor of automated electronic documentation system for trademarks (hereinafter referred to as AS ADMIN TM).

This transition to a new technology of preparation for the publication of information on all IP objects – the Inventions, Utility Models, Trademarks, Databases, Topologies of Integrated Circuits - allowed to exercise editorial check by examination departments at the earlier stage, namely on the stage of preparation of decisions to grant the patents on Inventions and Utility Models, as well as decisions on registration of Trademarks and Appellations of Origin, i.e. before payment of the fees.

Department of the FIPS which is in charge of preparation and production of the official information – the top management of the departments and examiners of the divisions- during the year took an active part in the Working Groups on Inventions, Utility Models and Trademarks (more than 50 working sessions) related to:

  • introduction to commercial operation of the automated information system of paperless electronic documentation for examination of inventions and utility models (AC EA), including training of employees to work with the new automated system, drafting job descriptions of employees concerning work in the system;
  • development of new technologies interaction among the departments (and new transition processes in each unit) related to the implementation of the State Registers of inventions and utility models or electronic medium.

In 2013, as a result of a large collaboration among the FIPS units, there are new opportunities to:

  • Prepare decisions to grant patents for invention, utility model with a preliminary editorial review, as well as to prepare for publication the specification and the first pages of specification for utility models in the new automated workstation of the editor of the AS EA at the earlier stage, i.e. before payment of the fees;
  • Prepare decisions on the state registration of Trademarks and Appellations of Origin for pre editorial review, and provide publication of information on the new workstation of the editor of the AS TM ADMIN at the earlier stage, i.e. before payment of the fees;
  • Prepare notice on state registration of Computer Programs, Databases and Topographies of Integrated Circuits for pre editorial review, and provide publication of information on the workstation of the editor of a new automated system AS DB CP at the earlier stage, i.e. before payment of the fees.

The above activities carried out during the reporting year will allow in 2014:

  • use a new paperless technology for publication related to inventions (last paper copy, entering the department for preparation and issue of official information for publication);
  • reduce the time of preparation for the registration and publication of information about inventions and utility models, and hence the terms of issue of Russian patents for inventions and utility models;
  • maintain the State Registers of inventions and utility models in electronic carriers.

5.5. Supply of Information Services

Patent and information service of Rospatent specialist, FIPS examiners and employees of organizations subordinated to Rospatent, and all other interested users of the Russian Federation and abroad is based on the SPC directly in VPTB (information desks), as well as in regime of the remote access: by providing information and telephone consultations, replays to written requests and posting of various information products at FIPS website.

Table 5.5.1 shows key indicators of information services provided by the Patent Library on the basis of the SPC for the last five years.

In 2013, more than 4,6 thousand requests for patent information services were provided for the readers VPTB FIPS and regional and foreign users: conducting patent and information search, performing factual inquiries; provision of certified copies of patent documents and other materials. The most part of the requests was related to search for the numbers of documents by the name of inventor and/or the name of organization.

The FIPS website patent provides an access for users as to variety of information retrieval systems and information products, including products developed by VPTB.

Updating and addition of materials, placed in the page «VPTB» of the FIPS website, are fulfilled on the permanent basis. «The Guide to the collections of VPTB and Internet resources», «Internet browser on patent information resources», «Recommendations on the list of the necessary methodological, legal, patent literature, documentation for the documentary patent departments and services of the state of scientific and educational sector and institutions that make up the National Nanotechnology Network»; Russian translations of the EPO publication «News of patent information» are updated and posted monthly. The bibliography lists to assist specialists of the regions on topical issues of intellectual property protection, judicial practice, commercialization of intellectual property for business, small and medium sized enterprises are posted monthly. Such information as «Frequently Asked Questions», «New Documents», «Thematic meeting», etc. are regularly updated

The Electronic Catalogue of patent law literature «Legal protection of intellectual property in the world: domestic and foreign publications» (as to 01.01.2014, Catalog includes information about 134.6 thousand documents) attracts a great interest among the users.

An abridged version of the Electronic catalog of patent law literature, which is updated quarterly and contains more than 83 thousand documents, is posted at the FIPS website.

The requests of the users to the information products of the Patent Library (VPTB) posted at the FIPS website are illustrated by Table 5.5.2.

Patent Library provides services for Rospatent specialists in the mode of the Selective Dissemination of Information (SDI). SDI system allows for the users to receive alarm information on publications relating to various aspects of legal protection of intellectual property rights all over the world. 120 participants of the system are registered as to December 2013. In 2013, SDI system was connected to faculty and staff of the Russian State Academy of Intellectual Property (RGAIS). Over 2013 the SDI users received 157.4 units of information.

A significant part of the users of services are the students of the Universities. During 2013 the department VPTB FIPS organized for the students of Moscow Universities 32 visits and workshops related to work with patent documentation, which was attended by over 400 people. Along with the Universities that already for several years participated in such events (RGAIS, MEPI, MISA, Moscow State Law Academy, Moscow State Technical University and others), in 2013 such visits were originated for students of Moscow State Pedagogical University and Moscow Aviation University.

In 2013 year 6 thematic meetings were organized at which presentations were made by the leading examiners of the FIPS. Among the participants of the meetings - the applicants and their representatives, scientists, teachers, students and post graduates students of the Universities, representatives of large industrial companies, small and medium-sized businesses, and other specialists interested in knowledge in the field of intellectual property protection. The above thematic meetings attended 448 people totally from Moscow and Moscow region, St. Petersburg, Tula, Tver, Irkutsk, Obninsk, Kharkov. In these meetings in mode of videoconference hold on the basis of regional TISC participated interested users from Belgorod, Saransk, Saratov, Tomsk and Ufa.

The Activities of the Rospatent Museum is aimed at patriotic education, promotion and popularization of knowledge on intellectual property. In 2013 the main exhibition of the Museum was updated, 32 thematic exhibitions dealing with current events in the world of intellectual property, anniversaries and memorial dates were organized, 2 photo contests was hold. Exhibitions were placed both in Museum and at the places next to it.

Provision of Official Publications of Rospatent and FIPS publications prepared on the basis of official information of Rospatent, were carried out in 2013 for a wide range of the users of patent information. Publications were issued primarily in electronic form on CD and DVD, and were accompanied by modern search tools and access to information.

In 2013, the official bulletins on all industrial property rights were published on CD and DVD, and equipped with the latest version of an information retrieval system MIMOSA. Over 300 annual sets of these publications were purchased by the users in 2013 (see Table 5.5.3). In addition, the latest numbers of all the said official bulletins were laid for free access on the Internet website of Rospatent.

International Classifications on CD and on Paper


A wide range of information products has also included the official publications in Russian of the international classifications of industrial property rights, presented in electronic form that provides opportunities for in-depth search of patent documents. In 2013, the subscribers were offered on CD by new edition of the International Patent Classification - IPC-2013.01, equipped with the Alphabetical Index. Also in 2013 the CD version of the new 10th edition of the International Classification of Goods and Services as amended, effective from January 1, 2013 was issued.

Quick access to the accumulated array of Invention on CD and DVD provides a quarterly search and reference unit (SPA) on DVD, containing abstracts information with links to full-text specifications posted on optical disks and Rospatent portal (Table 5.5.4). In 2013, this edition was provided for all the Technology and Innovation Support Centers (TISC) of the Russian Federation.

In 2013, production un the optical disks of arrays of retrospective patent information was continued: sets of Invention (since 1924), sets of Utility Models (since 1994), sets of information on Industrial Designs (since 1993), sets of information on Trademarks (since 1991). In 2013 was spread totally over 100 such sets (see Table 5.5.4).

In 2013 provision of services to users through the communication channels were continued, namely the official patent information were provided for in electronic form via the Internet to the world online services, providers of patent information.

Along with the issue of a wide range of electronic publications used in the mode of computerized search, in 2013 the interested users have been provided by publications on industrial property rights on paper (see Table 5.5.5). However, this form of service is increasingly replaced by modern electronic access capacities, which leads to further rejection of paper carrier for patent information.

The total number of subscribers to the official information in optical disk and informative publications on paper has a trend to decrease in recent years (see Table 5.5.6), which is associated with the reorientation of a large part of the user to obtain this information via Internet and other online systems.

However, the most large organizations and enterprises engaged in innovation activities (scientific, industrial, and educational) remain stable users of information products. In 2013, it may be also noted certain changes in distribution of subscribers depending of the nature of their activity: proportion of information services, offering customer service in the Russian regions is increased due to the development of TISC network in the Russian Federation (see Table 5.5.7) .

Distribution of the subscribers of the Russian Federation by regions is presented in Appendix 4. Still more than 70% of subscribers are located in the Central, North-West and Volga districts.

Rospatent and FIPS websites on the Internet in 2013 provided an access to a wide range of databases, including electronic publications (see section 4.2 of the Report).

The content and structure of the site, presenting the activity Rospatent within the framework of its competence (www.rupto.ru), reflect the most important issues of intellectual property protection system in Russia. Page «About Rospatent» was upgraded, where an interactive organizational structure Rospatent was posted as well as pages «Financing», «Fight against Corruption», «Public procurement» were amended. New sections: «Information resources of Rospatent», «Litigation», «Related Authorities», «Rospatent Decisions», project « Modernization of the intellectual property system in the Russian Federation « and the section» Objects of patent law « having general information on the provision of legal protection for inventions, utility models and industrial designs. Unloading capabilities for the users which need information have been provided in the new section of the site «Open Data», which 12 passports for public concerned wide access to public data of Rospatent are located.

In 2013 Rospatent portal and FIPS website (www.fips.ru) actively used simultaneously, focused on comprehensive customer support at various stages of the legal protection of intellectual property. The site FIPS, section «Conferences, seminars, exhibitions,» which has a new section dedicated to the Forum «Innovation potential of Russia» has been developed rapidly. Also this section has information concerning regional seminars, conferences and forums. Modernized structure under of section of site of FIPS website « Technology and Innovation Support Centers (TISC),» as well as section «Patent Information Products» are available, in which there are new documents and providing an access to official bulletin of Rospatent. FIPS develops section «Frequently Asked Questions» of the site which was recently created.
