4.1. Automated System Development and IT Modernization

There are three main dicertions of IT Development within which the major part of activities concerning thereof are to be perfomed in the period before 2020, namely:

  • Electronic processing;
  • Electronic interaction;
  • Development of the systems to support the decision making.

4.1.1. Procedures processed in the electronic form

The main aim of works on decreasing the paper flow is to make an electronic document become as common in use as the paper documents are.

In 2013 г. the electronic work flow was insured for the examination of applications for inventions and utility models and preparation of the decisions on granting of the patents (as of December 2013), examination of applications for the registration of computer programs, data bases and topographies of integrated circuits (as of January 2013), examination of international trademark applications and registrations (as of May 2013). Implementation of the relevant informational systems allowed achieving by the end of 2013 the following performance: more then 63% of all the documents are transferred in electronic format; about 35% of all the documents are prepared and signed in FIPS by electronic means; the preparation and signature of the documents by electronic means are insured to more then 60% specialists of the examination divisions.

Moreover, the following systems for the electronic processing were developed in 2013:

  • for the purpose of registration of the contracts related to all the object of IP, the system for paperless processing of the applications for the registration thereof (ASBBD “Contacts”) was created and tested;
  • for the purpose of the procedures implemented after the documents on grant of the protection to the objects of IP have been issued, the automated systems for the maintaining the State Registers for inventions, utility models, industrial designs, computer programs, data bases and topographies of integrated circuits was created and tested.

These two systems are expected to be put into operation during the first quarter of 2014.

In order to insure the electronic processing in relation to provision of the state services the following works were performed in 2013:

  • the automated system for paperless processing of the international trademark applications and registrations under the Madrid system procedures (including those filed by electronic means) (ASBBD “Madrid”) was put into industrial operation;
  • the automated system for paperless processing of the changes into the Registers for inventions, utility models, industrial designs (including, the data on extension of the validity and renewals of the patents) (ASBBD “Processing of the Patents”) was created and tested;
  • the creation of the automated system for paperless processing of the applications for industrial designs was processed;
  • the electronic State Register of Trademarks and Service Marks of the Russian Federation, the electronic State Register of Appellations of Origin of the Russian Federation and Electronic List of the Well-Known Marks of the Russian Federation (EGR TM) with the documents signed by the electronic digital signatures of the authorized persons was further updated - as of the end of December 2013, 113843 new registrations were added and 203205 registrations were transferred thereto from the State Register maintained on paper;
  • the stable functioning of the electronic data processing system for trademarks and service marks TM-ADMIN was ensured. The operation of the software for “grouping” the terms of goods and services listed in trademark applications / registrations with the terms of the lexical-semantic identifier of goods and services, which will allow examiners in future to compare automatically the lists of goods and services of the trademarks in question when making decisions, as well as to reduce labor costs in relation thereto. In technical mode, an editorial review of the draft decisions on the registration of TMs was carried out in order to reduce the number of errors detected at the stage of registration and issuing certificates. The interaction with the user’s personal account on the FIPS web-site was insured by means of automatic uploading of the electronic outgoing correspondence and e-signature files. The scope of the processed and stored data concerning applicants was expanded, namely: TIN, FCC, PSRN, RRC were included in regards to legal entities, and Insurance Number of Individual Ledger Account and TIN – in regards to individuals;
  • new functionality of the web-application of the ABS VPTB, allowing to create, in the framework of the cataloging, complicated analytic and multivolume records for each type of the publications, was incorporated; the maintaining of e-catalogue, in particular, recording of the full-text documents with a glance to the results of determination of the data resources being subject to time-expired copyright, was continued;
  • the communication of the paper flows to the Centre for Data Preparation (CPD) was continued; measures were taken to ensure the required CPD performance while converting the documents in electronic format, namely, additional AbbyFineReaderEngine licenses were set-up in order to insure multithreaded recognition with the possibility of a dynamic queue management recognition. The continuous automatic formatting of the recognized texts of the claims, descriptions and abstracts from the applications, together with the possibility of use of the predefined function for spell checking, is provided for. The scope of the identification data concerning applicants was expanded, in particular: TIN, FCC, PSRN, RRC were included in regards to legal entities, and Insurance Number of Individual Ledger Account and TIN – in regards to individuals when recording the bibliographic data on applications which is subject to integration into the relevant systems for processing. New types of the automatic checks of the contents of the electronic media (MChN), received together with the paper documents of the applications, were implemented for further use in the preparation of their e-versions. The automatic control of the timing for the document processing performed by the operators on the different traffic routing stages was insured;
  • further efforts for modernization of functionality of the electronic data processing system for inventions and utility models (AS EA) were made. In the course of the editorial check of the electronic folders, new algorithms for automatic dispatch thereof among editors, as well as bulk upload of the components of the applications used for profs printing (images of the publications) were implemented. The e-files of the applications are complemented now with the incoming correspondence images (as of July 2013 г.), and all the outgoing correspondence is indorsed by the improved e-signature. Moreover, all necessary conditions to make entries into the EGR were established. The uploading of the outgoing correspondence and e-signature files in respect to applications for inventions and utility models is accomplished.

4.1.2. Development of the e-interaction with the applicants

At the moment, applicants and their representatives may use, for interacting with FIPS, electronic means and services available on the FIPS web-site (www.fips.ru) and the Common Government Services Portal (www.gosuslugi.ru).

E-interaction with the applicants through the FIPS web-site

Applicants have a possibility to file their trademark and patent applications electronically, as well as to communicate the correspondence related to their earlier filings of trademarks, inventions, utility models and computer programs through the Personnel Account (Cabinet) Service.

During 2013, there were received about 6,5 thousands of e-filings for trademarks (~14% of the total amount of the trademark applications) and more than 600 e-filings for inventions (~1,5% of the total amount of the applications). In order to file an application for trademark, invention or any other IP object, the requirement for the enhanced encrypted and certified digital signature should be met as to Regulation № 634 of 25.06.2012 by the Government of the Russian Federation. Moreover, Personnel Account, being available on the FIPS web-site, contains more then 2 000 dossiers which are subject to the e-communications.

The dynamics of the e-filings of trademark applications, percentage-wise to the total amount of trademark applications filed in 2010 – 2013, is illustrated in Diagram 1.

To come up to the goal of 25% e-filings by 2015, the measure for the e-filing system promotion among the users were taken in 2013, in particular by improving the system functionality, providing access to the e-filing services through TISCs, as well as integrating the informational systems of other organizations into the FIPS e-filing system.

E-interaction with Applicants through the Common Government Services Portal

The Common Government Service Portal (CGSP) contains description of the state services rendered by Rospatent. In October 2013, the description of those 13 services available on the CGSP was updated. In respect to each service, the required filing forms and the rules for rendering thereof were made available in the Portal.

The CGSP provides for the interactive filing forms in relation to the following services:

  • receipt of the applications for inventions of the Russian Federation, examination and grant of the patents thereof;
  • receipt of the applications for industrial designs, examination and grant of the patents;
  • receipt of the applications for utility models of the Russian Federation, examination and grant of the patents thereof;
  • receipt, examination and registration of the applications for trade or service marks;
  • receipt, examination and registration of the applications for appellations of origin and exclusive rights thereto, as well as for the exclusive right to the earlier registered appellations of origin;
  • state registration of the pledge contracts (subsequent pledge) in respect to the exclusive right to the registered invention, industrial design or utility model.

During 2013 71 applications were filed through the CGSP, namely:

  • for inventions – 9;
  • for utility models – 4;
  • for industrial designs – 1;
  • for trademarks – 56;
  • for appellations of origin – 1.

In 2013, the terms of reference for the creation of new interactive filing forms and updating of those already available on the CGSP were prepared and forwarded to the Ministry for Communications of the Russian Federation in relation to the following service:

  • receipt, examination and registration of the applications for computer programs and data bases;
  • receipt, examination and registration of the applications for the topographies of integrated circuits;
  • state registration of contracts on granting the right to use intellectual property objects or franchising contracts in respect thereto.

4.1.3. Development of the systems to support the examiners in the decision making

At the moment, the main activities implemented within this direction include research and development held for the further improvement of the informational search system PatSearch on the basis of the existing patent document arrays and experience gained in the process of creation and use thereof. The common objective is to expand the frameworks of implementation of the IT under the substantive examination procedures and to reduce examiners’ labor efforts. This direction is of the great potential for future development. Main activities performed in 2013-2014 were focused on the research in the informational search. Today, the informational search system PatSearch, by means of the functionality for the “similar documents search” (fully automatic), allows to find 38% refuses with references to Russian patent documents (only first 20 documents were taken into consideration).

The main activities on the improvement of the search “for similarity” functionality include:

  • consideration of the patent documents peculiarities (weight setting for the detection of the patent families, IPC and etc.);
  • linguistic support in the part of recoding of an anaphoria and coreference links (non-obvious designation of the object or situation in the text);
  • use of the dictionaries of synonyms and equivalents;
  • semantic search on the basis of the proximity of the semantic networks of documents (among key themes of the document);
  • multilingual search in the global collection of patent documents based on the use of dictionaries of synonyms and equivalents.

4.2. Information and Search System for the Examination of Inventions and Utility Models PatSearch

In 2013, for the purposes of the examination of inventions and utility models, information and search system PatSearch was used. PatSearch is a professional search system for the examiners performing examination of inventions and utility models. In this connection, this system has a wide set of functional and servicing possibilities.

In 2013 the searching arrays of patent documentation of the PCT minimum countries, as well as the basic array of extended abstracts and bibliographic data of Derwent Co. (Thompson Reuter) DWPI were uploaded into the system. The system contains arrays of patent documents of the former-USSR and Russia, the CIS, the PCT, the EPO, the USA, Germany, the United Kingdom, France, Austria, Australia, ARIPO, OAPI, Republic of Korea, as well as English-language abstracts and patent documents of Japan and other countries. In total, there are more than 43 million of patent documents in the languages of the originals. Access to the full descriptions of patent documents, which have not been uploaded into the system yet, but being found by the DWPI index, is provided for by the incorporated on-line query to the EPO arrays. The search for non-patent literature is realized by integrated request to the external digital library E-Library or to the largest non-patent literature database Scopus.

The enlarged list of the main system functionalities contains the following:

  • Search in selected arrays
  • View of indexes during preparation of the query
  • Sample analysis (statistics on the results of the search)
  • Viewing of the documents (where the search terms are highlighted)
  • Two-window viewing of the documents
  • Printing of documents
  • Exporting of documents
  • Taking into consideration of the IPC reform and subsequent reclassifications
  • Search taking into account the European Patent Classification ECLA, the American Patent Classification USPC, as well as the Derwent company classifier
  • Multilingual automatic translation (including translation of the selected fragment of the document or of the document as a whole, separate regime of query translation)
  • Analytical treatment of the search results (including cluster analyses and construction of semantic networks)
  • Search in the Esp@cenet
  • Search in the E-Library
  • Search in the Scopus
  • Search of amino acids and nucleotide sequences in European databank EMBL.

In 2013 new improved version of the system for automated translation PROMT was put into operation. In the reporting year, the full text search of documents in the arrays of Japan in Japanese language was also implemented. The search history recording function, including the possibilities of specification of the search arrays, texts of the search documents, number of the documents revised, as well as the list of documents included by the examiner into the result selection, was widely used.

In 2013 additional tools for searching over the range of numbers in the text fields were integrated in the PatSearch, which in particular provides for the search over the range of numbers represented in the form of a standard deviation. For instance, when number “1350” is indicated in the search request, the result will include the document containing numbers “1400±100”.

The Figure 4.2 shows the search results found at the following request: « reaching AND rough stock AND density AND AB=1350».

In total, the system contains more than 93 millions of patent documents.

4.3. Use of the Rospatent Internet Resources

During 2013, the following resources were available for the user of the Internet:

  • Information search system (ISS) of the national patent documents;
  • Registers of Russian patent documents of all the types of industrial property;
  • Register of trademark applications filed in 2005–2013, complemented by the proceeding data on the applications filed in 2008–2013;
  • Register of the applications for appellations of origin of the Russian Federation filed in 2005–2013, complemented by the proceeding data on the applications filed in 2008–2013;
  • Registers, containing information on the processing of applications for patents, utility models and industrial designs filed in 2007–2013;
  • Official bulletins of Rospatent: “Inventions. Utility Models”, “Trademarks, Service Marks and Appellations of Origin”, “Industrial Designs”;
  • Official Bulletin of Rospatent “Computer Programs, Databases, Topographies of Integrated Circuits”.
  • Daily published data on current registrations of trademarks, service marks, appellations of origin, well-known marks, and notifications on change of entries in the State Register of Trademarks before their publication in the Official Bulletin “Trademarks, Service Marks and Appellations of Origin”.

The Internet Resources of Rospatent include the following databases:

  • a full text database of Russian inventions (containing information on 511 thousand patents for inventions, covering the period from 1994 up to 2013), updated three times per month;
  • a backdating database of Russian patent documents presented in facsimile format (containing information on 1433 thousand patent documents for inventions covering the period from 1924 up to 1993);
  • an abstract database of Russian inventions (containing information on 527 thousand patents for inventions, covering the period from 1994 up to 2013), updated three times per month;
  • a database of published applications for inventions (containing information on 421 thousand applications, covering the period from 1994 up to 2013), updated three times per month;
  • database of English language abstracts of Russian inventions (containing information on 535 thousand patents, covering the period from 1994 up to 2013), updated three times per month;
  • a full-text database of Russian utility models (containing information on 136 thousand Russian certificates and patents for utility models, covering the period from 1996 up to 2013), quarterly updated;
  • an abstract database of Russian utility models (containing information on 136 thousand certificates and patents for utility models, covering the period from 1996 up to 2013), updated three times per month;
  • a database of Russian trademarks (containing information on 427 thousand Russian certificates for trademarks, covering the period from 1925 up to 2013), daily updated;
  • a database of the international trademark registrations designating the Russian Federation (containing information on 259 thousand international registrations with designation of Russia, covering the time period from 1980 up to 2013), weekly updated — the access is provided for subscribers to the Trademark databases;
  • “Prospective inventions” database (containing information on 1,2 thousand patents for inventions considered by FIPS to be prospective), quarterly updated;
  • a database “Appellations of Origin” (containing information on 134 appellations of origin and 298 certificates of the exclusive right to them covering the time period from 1997 up to 2013), daily updated — the access is provided for subscribers to the Trademarks databases;
  • a database “Well-known Russian Marks” (containing information on 136 well-known Russian marks), daily updated — the access is provided for subscribers to the Trademarks databases;
  • a database of industrial designs (containing information on 51 thousand patents for industrial designs, covering the time period from 1993 up to 2013), monthly updated;
  • a database of computer programmes (contains information on 10,5 thousand registrations granted as of 2013), quarterly updated;
  • a database of the registered data bases (contains information on 1,3 thousand registrations granted as of 2013), quarterly updated;
  • a database of the topographies of integrated circuits (contains information on 165 registrations granted as of 2013), quarterly updated;
  • a database of Russian trademark applications filed during 2005-2013 (containing information about 370 thousand applications), daily updated;
  • a database of applications for inventions filed in 2007-2013 (containing information about examination procedure on 293 thousand applications), daily updated;
  • a database of applications for utility models filed in 2007–2013 (containing information about examination procedure on 87 thousand applications), daily updated;
  • a data base of applications for industrial designs filed in 2007–2013 (containing information about examination procedure of 31 thousand applications), daily updated;
  • International Patent Classification Database;
  • International Classification of Goods and Services Database;
  • International Classification of Industrial Designs Database.

Use of the Information and Search System

Access to the full text DB of inventions, utility models, trademarks and industrial designs is provided to the external users on a contractual basis.

According to the Program of Regional Cooperation between Rospatent and the Regions of the Russian Federation, 153 organizations received the free access to the full text databases of inventions und utility models.

Within the agreements on cooperation between Rospatent and corresponding organizations the free access was provided:

  • for the full text databases of inventions and utility models:

*to 40 organizations participating in the implementation of the state project on the nanotechnology development;

*to 84 technical and support centers;

  • for the databases of trademarks — to 5 organizations of the Federal Customs Service of the Russian Federation;
  • for the all FIPS databases to:

*84 organizations of the Federal Court Bailiffs Service;

*170 organizations of the Ministry of Internal Affairs of the Russian Federation;

*11 organizations of the Federal Antimonopoly Service;

*16 organizations of the Ministry of Defense;

*101 organizations of the Federal Tax Service.

External users are provided with a free access to the following products:

In respect to inventions:

  • Abstract DBs in Russian and English;
  • DB of published applications for inventions;
  • DB «Prospective inventions»;
  • Full text DB containing documents published in three recent Bulletins “Inventions. Utility Models”;
  • IPC DB;

In respect to utility models:

  • Full text DB containing documents published in three recent Bulletins “Inventions. Utility Models”;
  • DB of abstracts;
  • IPC DB;

In respect to trademarks:

  • DB containing documents published in two recent Bulletins “Trademarks, Service Marks and Appellations of Origin”;
  • DB related to the International Classification of Goods and Services.

In respect to industrial designs:

  • DB containing documents published in the recent Bulletin “Industrial Designs”;
  • DB related to the International Classification of Industrial Designs.

In 2013 more than 705 contracts on provision the access to the commercial data bases were concluded. The total number of contracts concluded during the whole period of the system operation amounts to 11000, among them more than 8300 thereof had been valid by the end of 2013.

In 2013 internal and external users made more than 3 777 thousands search queries in the ISS, namely:

more than 224 thous. – by internal users;

more than 2 914 thous. – by external free users;

more than 639 thous. – by external commercial users .

Diagram 2 shows the distribution of the queries processed by the ISS in 2004–2013.

Use of the Registers for Russian Patent Documents

The users of Registers enjoyed free access to all patent documents available in the Internet resources of Rospatent.

In 2013 the total number of queries submitted by internal and external users to the Registers amounted to 23732 thousand, whereas:

  • about 303 thousand were entered by the internal users of the databases;
  • over 23429 thousand were entered by the external users of the databases.

Diagram 4 shows the distribution of queries to Registers by years.

Use of the Rospatent Bulletins

During 2013, users enjoyed a free access to the following Rospatent Bulletins:

  • “Inventions. Utility Models” (three last published Bulletins);
  • “Trademarks. Service Marks. Appellations of Origin” (two last published Bulletins);
  • “Industrial Designs” (to the recent published Bulletin);
  • “Computer programs, Databases. Topographies of Integrated Circuits (to the recent published Bulletin).

In 2013 the total number of queries to the Rospatent electronic bulletins amounted to 2151 thousand.

4.4. Use of Databases for the Purposes of Examination of Inventions and Utility Models

The Rospatent internal search system PartSerch, being installed on the working stations of all examiners, was the main searching instrument used during the examination process during 2013. The search array of the system of patent documentation of the Russian Federation and the former USSR, the CIS countries, arrays of the foreign patent documents included in the PCT minimum documentation, as well DB DWPI. PatSerach allows performing searches of non-patent literature, including search for genetic sequences, in the external sources Simultaneously, all examiners are provided for a free access to all search data bases of the foreign patent offices and non-patent literature data bases.

4.4.1. On-line Search

In 2013, all searches were performed by the examiners in the online mode. If for any reasons the data provided in the PatSearch system was not enough for performing the examination, an additional patent information is usually received from the DB freely accessible via Internet (e.g. Esp@cenet, PATENTSCOPE, EAPATIS, DEPATISNET, DBs of the USPTO and JPO, DPMA DB WIPO and the search system of the Eurasian Patent Office).

For acquiring of the data from the applications of the JPO and KIPO are provided for the access to the DBs AIPN and K-PION, accordingly. Besides, according to the agreement between FIPS and the European Patent Office (EPO), the access to one working station of the EPO internal search system EpoqueNet was insured.

If required, examiners continue using commercial data bases. The majority of searches were performed on the basis of the STN International platform usually being used for searching in the field of Chemistry, Pharmacy and Biotechnology.

The access to the STN is provided for examiners in the specially equipped Online Access and Consolation Room, where they can receive assistance from qualified staff, who if necessary perform searches jointly with examiner. During 2013 there were conducted over 1300 of such searches in the Room. The majority of them were performed in the DB REGISTRY, CA, CASREACT и CHEMCATS.

Besides supporting to search in the STN network, specialists of the Room consult the examiners on searching in other on-line data bases. During 2013 more than 350 of such consultations were made.

In order to improve the informational support for the examiners, the specialists of the Room investigate on-line database which may be useful for the purposes of informational search, as well as issue the mythological recommendations in respect thereof to be used by the examiners. They also participate in training both young and skilled examiners on the issues related to the use of the available DBs.

4.4.2. Search of the Non-Patent Scientific and Technological Information

For the purpose of presenting searches of the non-patent scientific and technological literature, examiners are provided from their working stations for the access to the DB Scopus and abstract scientific and technological data bases available on the web-site of the RFBR Scientific electronic library.

The web-sites of the libraries and specialized and polythematic databases in the field of medicine, biology, biotechnology, chemistry, pharmaceutics, as well as the search systems Google, Rambler, Yandex may also be used by examiners form the working station.

Besides, in order to expand the search range, examiners may apply to the special search rooms where the access to the local DB, subject-matter DB on optical disks, patent and non-patent DB freely accessible via Internet and to the commercial DB VINITI.

The frequency of references to the various databases for searching scientific and technological literature in the «Training and Computer Search» Room (besides, the access form the working stations) is shown in Diagram 6 and Table 4.4.2.

The above Diagram and Table show that the DB VINITI is customarily the most frequently used search resource in the «Training and Computer Search» Room (besides, the access form the working stations). It contains abstracts of foreign and national sources of scientific and technological literature. This DB is derived from the periodic and serial editions, books, dissertations, materials of the conferences, abstracts, patents, normative documents, deposited scientific works. Russian sources constitute 30% thereof.

4.4.3. Training on Use of Databases

As in previous years, in order to ensure the required quality of the work, training of both young and skilled examiners on proper exploitation of various instruments for the information search is carried out permanently. Consultations on the issues related to the informational search are permanently provided in the search rooms. The main emphasis was upon Rospatent search system PatSearch and its updates, as well as the additional informational resources. The above additional informational resources are usually used for the purposes of search of the full-text documents of the national patents, automatic translation thereof in English, as well as access to the application dossiers.

According to the Schedule of Education, examiners were invited to pass the trainings on the issues related to the different aspects of search which are conducted under the special programmes and involve plenty of practical activities. At the request of the divisions, examiners were also invited to re-pass the training or to complete it individually, to insure the better digestion of the materials. Moreover, the training of the examiners, who had previously failed to pass it, was conducted. As to the special Schedule, all new examiners passed the compulsory education on the use of automated systems and electronic databases selected for examination search.

At the request of the organization cooperating with Rospatent the training on the informational search issues is carried for their employees.

Table 4.4.3 reflects the statistics relating to the training of examiners.

The above training was conducted on the basis of the differentiated approach. The special training programmes provide for the qualification upgrading of the examiners with different background level and for their self-guided work with the electronic information resources using the knowledge gained.

4.4.4. Implementation of the Automated Text Translation System

During 2013 maintenance of the machine translation system PROMT available to the examiners was continued. In the beginning of the year, the inventory reconciliation was performed in order to insure installing of the system on each examiner’s working station and recording thereof. According to the signals from the examination divisions, configuring and troubleshooting were conducted in order to insure uninterrupted access to the translation system. Consultations on all the issues regarding the work in the PROMT from the working stations were provided at the request of the examiners in the divisions and Room for training and computer search.

The work relating to creation of the English-Russian users’ dictionaries on narrow examination topics was continued in order to improve quality of the translation and integration thereof in the PROMT. Within improving of the tools effecting on the quality of the translation, the table of correspondence of the PROMT specialized dictionaries and IPC codes. Examiners were surveyed in order to evaluate the new version of the system being installed on the working stations and in the PatSearch, which would allow considering the proposals and desires in relation thereto. The above works will be continued in future. It will help to improve the PROMT translation tools and the quality of the translation of the foreign patent documentation.

4.5. Development of the Infrastructure

In 2013 Rospatent and FIPS agreed on conversion of the main automated informational systems to a new hardware platform. The server М10-4S, planned to be purchased in 2014, and server Primepower 1500, utilized at the present time, have the same architecture platform, which will allow fluent transferring of the Rospatent informational systems from the old server to the new one. The server М10-4S contains 8 processing units. Four 16-core processors of a core frequency of 3.0 GHz and 512 GB of the ram memory are installed in each of the above mentioned units. The current server Primepower 1500 contains 32 processors х 1 core = 32 cores. The server М10-4S, planned to be purchased, has 8 blocks х 16 cores = 512 cores, and may be expanded at least up to 64 processors (up to 1024 processors cores) and 32 TBytes of the ram memory. It also allows the creation about 16 hardware-independent partitions (these partition are the nonvolatile servers with their own operating system and set of applications).
