4.1. ProgFram for Complex Modernization of Automated Systems

Development of Automated Systems and Improvement of Information Technologies

The Three-Year Program for Development of Information Technologies was adopted in December, 2011. The above Program includes the following objectives to be reached by 2015:

  • 25% applications shall be filed in electronic form;
  • the Federal Institute of Industrial Property (FIPS) shall be provided by the possibility of becoming paperless office.

Electronic data processing

In order to arrange for the electronic data processing for the provision of the sate services by FIPS, the following activities were performed in 2012:

  • development and operation testing of the automated system for the electronic processing of the data relating to the registration of computer programs, databases and topographies of integrated circuit (ASBBD “PrEVM, BD, TIMS”);
  • development and operation testing of the automated system for the electronic processing of the international trademark applications and registrations filed according to the Madrid System, including e-filings (ACBBD “Madrid”);
  • further updating of the electronic State Register of Trademarks and Service Marks of the Russian Federation, State Register of Appellations of Origin of the Russian Federation and Electronic List of the Well-Known Marks of the Russian Federation (EGR) with the documents signed by the electronic digital signatures of the authorized persons. As for the end of December 2012, 88848 new registrations were placed in the EGR, while 151958 registrations were transferred from the State Register maintained on paper;
  • development of the automated systems for maintaining the Sate Register of Inventions of the Russian Federation, the Sate Register of Utility Models of the Russian Federation, the Sate Register of Industrial designs of the Russian Federation, Register of Computer Programs, Register of Databases and Register of Topographies of Integrated Circuit by electronic means;
  • development of the automated system for paperless processing of the requests for the state registration of the contracts relating to industrial property rights (ASBBD “Contracts”);
  • development of the automated systems for paperless processing of the requests for the entry of changes into the registers of inventions, utility models, industrial designs, including extension or reinstatement of the validity of a patent) (ASBBD “Patent Data Processing”).

In 2012 a new web-tool to the Automated Library System VPTB FIPS (ABS VPTB) providing for the possibility of electronic catalogue creation was put into operation. Ensuring on-line access to the databases and electronic resources will allow tiding over the obstacles connected with organization of the working stations of experts working in VPTB outside FIPS. The web-tool supports the functions of entry, search and reading of the information. The universal module for cataloguing (UMKa) was created by means of unification and standardization of the single-type functions of 10 ABS modules, and development of the uniform rules for operating with program modules; so the uniform database with settings was developed.

During 2012 the stable functioning of the electronic data processing system for trademarks and service marks TM-ADMIN was ensured. Access to the system is provided to all examiners and experts dealing with incoming correspondence of the Trademark Application Processing Division. The total amount of its users constitutes 430 persons. The system was successfully interconnected with the AS “Fees”. The efforts on speeding and efficiency improving were made, including reengineering of the business processes.

In 2012 new processing thread of the data from the Centre for Data Preparation (CPD) was put into test operation, which is aimed at transferring the documents into electronic form in order to be integrated in such data processing systems as AS “Legal Decisions”, AS BBD PPS, ABD, electronic data processing systems for inventions and utility models (AS EA). Unification of the single-type documents processing and use of modern identification tools will enable quality improvement of the electronic documents uploaded in the data processing systems.

In 2012 further efforts for modernization of functionality of the electronic data processing system for inventions and utility models were made in respect to providing for editorial check of the documents at the stages of passing the decisions on granting patents for inventions or utility models, signing the decisions on granting by encrypted digital signature and entry of the data in electronic state registers. The conditions for putting the new system into industrial operation were provided. The processing of paper documents and additional materials attached to the applications for inventions or utility models by means of specially created CPD threads will allow forming the electronic dossiers of the applications in the AS EA.

In order to organize in 2012 the electronic data exchange (by means of the PCT-EDI) between RU/RO, RU/ISA and WIPO using the automated system “Electronic Library of the PCT Applications”, the certified copies of the priority applications, as well as materials of outgoing and incoming correspondence were inserted in the package to be communicated to WIPO. As far as Russian Receiving Office is concerned (RU/RO), in 2012 functionalities for processing the certified copies of the materials attached to the applications and preparing the outgoing correspondence in the format corresponding to the PCT-EDI requirements were ensured, as well as integration of the Module “Scanning of the OC in the Format corresponding to the PCT-EDI requirements” into the Receiving Office Tool “AS Electronic Library of the PCT Applications” was implemented.

During 2012 the efforts on modernization of the system for e-filing of the applications for inventions and trademarks were performed.

System for e-filing of the trademark applications

In 2012 the stable operation of the system for e-filing of the trademark applications and electronic interaction with the applicants (KPS RTZ) was ensured. The support of using the keys of the accredited certification centers for e-filing of the trademark applications was provided. The software required to arrange the filing of applications with FIPS receiving points was developed.

During 2012 3760 applications were filed by means of the KPS RTZ, which is equal to 9% of the total amount of trademark applications. The dynamics of the e-filings of trademark applications, percentage-wise to the total amount of trademark applications filed in 2012, is illustrated in Diagram 1.

System for e-filing of the patent applications for inventions

In 2012 exploitation of the system for e-filing of the patent applications for inventions, being available through the FIPS Internet Portal was proceeded. At that, the positive dynamics showing the quantitative surplus of the filed applications, in comparison with the previous period, was noted (the exploitation was started in 2011).

During the reporting year 397 applications were filed electronically, which constitutes 0,91% of the total amount of the applications for inventions filed with Rospatent. The dynamics of the e-filings of applications for inventions, percentage-wise to the total amount of applications for inventions filed in 2012, is illustrated in Diagram 2. The peak figure of the applications filed by electronic means constitutes 2,02% of the total amount of applications for inventions.

The average number of the e-filings in 2012 amounted to 33,1 applications per month, changing monthly from 5 to 74 thereof. The distribution of the amount of the e-applications for inventions over the months is presented in Diagram 3.

The number of users of the e-filing system was doubled in comparison with 2011 and came up to 119 persons.

In 2012 development of the information technologies was carried out according to the programs initiated by the Government of the Russian Federation on:

  • Common Site and Municipal Services Portal (PGU);
  • System of Interdepartmental Electronic Interaction (SMEV), including transition to the electronic interaction with the Treasury;
  • creation of the basic state information recourses (BGIR).

As of December 2012, approximately 16% of the FIPS employees directly involved in the provision of the state services were carrying out proceedings by electronic means. After the systems developed in 2012 are put into operation, the percentage of the employees carrying out proceedings by electronic means will increase to 70%.

For the purposes of fulfilling overall objectives of the programme, 2013 will become a crucial year — the extent of the IT penetration into the working proceedings will dramatically increase; which will allow refusing the paperflow inside FIPS in the near future, reduce costs and time for communications, raise effectiveness of the work carried out both by examination and non-examination divisions.

4.2. Information and Search System for the Examination of Inventions and Utility Models “PatSearch”

In 2012 Rospatent continued the industrial operation of the Information and Search System for the Examination of Inventions and Utility Models (ISS) PatSearch.

PatSearch is a professional search system for the examiners performing examination of inventions and utility models. In this connection, this system has a wide set of functional and servicing possibilities.

In 2012 the searching arrays of patent documentation of the PCT minimum countries, as well as the basic array of extended abstracts and bibliographic data of Dervent Co. (Thompson Reuter) DWPI were uploaded into the system — in total, more than 48 million of documents. This array is a basic source of search indexes. The system contains arrays of patent documents of the former-USSR and Russia, the CIS, the PCT, the EPO, the USA, Germany, the United Kingdom, France, Austria, Australia, ARIPO, OAPI, Republic of Korea, as well as English-language abstracts and patent documents of Japan and other countries. In total, there are more than 43 million of patent documents in original language. Access to the full descriptions of patent documents, which have not been uploaded into the system yet, but being found by the DWPI index, is provided for by the incorporated on-line query to the EPO arrays. The search for non-patent literature is realized by integrated request to the external digital library E-Library or to the largest non-patent literature database SCOPUS. The major part of the arrays is represented by facsimile images of patent descriptions and required huge memory volume for their deployment — several dozens of TB. Simultaneously, the efforts to ensure required efficiency (up to 1000 users) and performance (5–10 seconds for standard search) on the full array of documentation was made.

Another functionality of the ISS being important for the users includes the possibility to use the automated translation of selected documents from foreign languages. The system also provides for the possibility to control the quality of the examiner’s work while carrying out the information search.

The enlarged lists containing the main functions of the system are mentioned below.

  • Analytical treatment of the search results (including cluster analyses and construction of semantic networks)
  • Search in the Esp@cenet
  • Search in the E-Library
  • Search in the SCOPUS
  • Search of amino acids and nucleotide sequences in European databank EMBL.

In 2012 new improved version of the system for automated translation PROMT 9.5 was into operation.

In the reporting year, within the improvement of PartSearch, the work on providing the safety distal operating mode for examiners was continued.

Moreover, further efforts for the development of the full text search of documents in the arrays of Japan in Japanese language were made.

The search history recording function, including the possibilities of specification of the search arrays, texts of the search documents, number of the documents revised, as well as the list of documents included by the examiner into the result selection, were enhanced.

Additionally, there is an opportunity to perform search in the EPO system Esp@cenet, in the digital libraries E-Library and Scopus, and in the European databank of genetic sequences EMBL.

In order to ensure the efficient implementation of the systems into the practice the two-stage training course for examiners on PatSearch consisting of “Basic Training Course” and “Extended Course” was developed and is widely used.

4.3. Exploitation of Internet Resources of Rospatent

In 2012 the access to the following resources was provided through the FIPS web-site:

  • Information search system (ISS) of the national patent documents;
  • Registers of Russian patent documents of all the types of industrial property;
  • Register of trademark applications filed in 2005–2012, complemented by the proceeding data on the applications filed in 2008–2012;
  • Register of the applications for appellations of origin of the Russian Federation filed in 2005–2012, complemented by the proceeding data on the applications filed in 2008–2012;
  • Registers, containing information on the processing of applications for patents, utility models and industrial designs filed in 2007–2012;
  • Official bulletins of Rospatent: “Inventions. Utility Models”, “Trademarks, Service Marks and Appellations of Origin”, “Industrial Designs”;
  • Daily published data on current registrations of trademarks, service marks, appellations of origin, well-known marks, and notifications on change of entries in the State Register of Trademarks before their publication in the Official Bulletin “Trademarks, Service Marks and Appellations of Origin”;
  • Official Bulletin of Rospatent “Computer Programs, Databases, Topographies of Integrated Circuits”.

The Internet Resources of Rospatent include the following databases:

  • a full text database of Russian inventions (containing information on 447 thousand patents for inventions, covering the period from 1994 up to 2012), updated three times per month;
  • a backdating database of Russian patent documents presented in facsimile format (containing information on 1433 thousand patent documents for inventions covering the period from 1924 up to 1993);
  • an abstract database of Russian inventions (containing information on 495 thousand patents for inventions, covering the period from 1994 up to 2012), updated three times per month;
  • a database of published applications for inventions (containing information on 394 thousand applications, covering the period from 1994 up to 2012), updated three times per month;
  • database of English language abstracts of Russian inventions (containing information on 503 thousand patents, covering the period from 1994 up to 2012), updated three times per month;
  • a full-text database of Russian utility models (containing information on 123 thousand Russian certificates and patents for utility models, covering the period from 1996 up to 2012), quarterly updated;
  • an abstract database of Russian utility models (containing information on 123 thousand certificates and patents for utility models, covering the period from 1996 up to 2012), updated three times per month;
  • a database of Russian trademarks (containing information on 402 thousand Russian certificates for trademarks, covering the period from 1925 up to 2012), daily updated;
  • a database of the international trademark registrations with designation of the Russian Federation (containing information on 243 thousand international registrations with designation of Russia, covering the time period from 1980 up to 2012), weekly updated — the access is provided for subscribers to the Trademark databases;
  • “Prospective inventions” database (containing information on 1 thousand patents for inventions considered by FIPS to be prospective), quarterly updated;
  • a database “Appellations of Origin” (containing information on 127 appellations of origin and 298 certificates of the exclusive right to them covering the time period from 1997 up to 2012), daily updated — the access is provided for subscribers to the Trademarks databases;

Use of the Information and Search System through the FIPS Internet Portal

Access to the full text DB of inventions, utility models, trademarks and industrial designs is provided to the external users on a contractual basis.

According to the Program of Regional Cooperation between Rospatent and the Regions of the Russian Federation, 149 organizations received the free access to the full text databases of inventions.

Within the agreements on cooperation between Rospatent and corresponding organizations the free access was provided:

  • to the full text databases of inventions:
    • to 40 organizations participating in the implementation of the state project on the nanotechnology development;
    • to 76 technical and support centers;
  • to the databases of trademarks — to 5 organizations of the Federal Customs Service of the Russian Federation;
  • to all FIPS databases to:
    • 84 organizations of the Federal Court Bailiffs Service;
    • 170 organizations of the Ministry of Internal Affairs of the Russian Federation;
    • 10 organizations of the Federal Antimonopoly Service;
    • 16 organizations of the Ministry of Defense
    • 101 organizations of the Federal Tax Service.

External users are provided with a free access to the following products:

In respect to inventions:

  • Abstract DBs in Russian and English;
  • DB of published applications for inventions;
  • DB «Prospective inventions»;
  • Full text DB containing documents published in three recent Bulletins “Inventions. Utility Models”;
  • IPC DB;

In respect to utility models:

  • Full text DB containing documents published in three recent Bulletins “Inventions. Utility Models”;
  • DB of abstracts;
  • IPC DB;

In respect to trademarks:

  • DB containing documents published in two recent Bulletins “Trademarks, Service Marks and Appellations of Origin”;
  • DB related to the International Classification of Goods and Services.

In respect to industrial designs:

  • DB containing documents published in the recent Bulletin “Industrial Designs”;
  • DB related to the International Classification of Industrial Designs.

In 2012 internal and external users made more than 4918 thousands search queries in the ISS.

Use of the Registers for Russian Patent Documents

The users of Registers enjoyed free access to all patent documents available in the Internet resources of Rospatent.

In 2012 the total number of queries submitted by internal and external users to the Registers amounted to 24047 thousand, whereas:

  • about 276 thousand were entered by the internal users of the databases;
  • over 237711 thousand were entered by the external users of the databases.

Use of the Rospatent Official Bulletins

Users enjoy a free access to the following Rospatent Bulletins:

  • “Inventions. Utility Models” (three last published Bulletins);
  • “Trademarks. Service Marks. Appellations of Origin” (two last published Bulletins);
  • “Industrial Designs” (to the recent published Bulletin);
  • “Computer programs, Databases. Topographies of Integrated Circuits (to the recent published Bulletin).

During 2012 the total number of queries to the Rospatent electronic bulletins amounted to 2161 thousand.

4.4. Interaction with the Common Government Services Portal

The Common Government Service Portal provides for the description of 13 government service rendered by Rospatent:

  • accreditation, registration, grant of the certificates to the patent attorneys, as well as review of the patent attorneys’ activities;
  • maintenance of the registers of the Intellectual Property objects and publication of the data relating to them;
  • state registration of the computer programs and databases;
  • state registration of the topographies of integrated circuits;
  • arrangement of processing of the applications for grant of the state registration of trademarks or service marks, requests for recognition a trademark or a sign used as a trademark without grant of the legal protection within the Russian Federation to be well-known in the Russian Federation, registration and grant of the certificates of the Russian Federation;
  • arrangement of processing of the applications for appellations of origin, registration and grant of the certificates of the Russian Federation;
  • filing the applications for inventions, examination and grant of the patents of the Russian Federation for inventions;
  • filing the applications for utility models, examination and grant of the patents of the Russian Federation for utility models;
  • filing the applications for industrial designs, examination and grant of the patents;
  • invalidation or cancellation of the legal protection granted to a trademark, service mark or appellation of origin, invalidation or cancellation of a patent for a invention, industrial design, utility model (certificate), certificate granting the right to use an appellation of origin;
  • extension of the validity term or renewal of patents;
  • registration of contracts on granting the right to use the an invention, utility model, industrial design, trademark, service mark, protected computer program, database, topography of integrated circuits, franchising contracts for the intellectual property objects protected according to the provisions of the legislation of the Russian Federation;
  • registration of the contracts on transfer of the rights to a single technology to abroad.

The access to the required forms and templates of requests is provided in respect to all above services.

The Portal contains the interactive forms for the request to the following services:

  • filing the applications for industrial designs, examination and grant of the patents;
  • filing the applications for inventions, examination and grant of the patents of the Russian Federation for inventions;
  • filing the applications for utility models, examination and grant of the patents of the Russian Federation for utility models;
  • arrangement of processing of the applications for grant of the state registration of trademarks or service marks, requests for recognition a trademark or a sign used as a trademark without grant of the legal protection within the Russian Federation to be well-known in the Russian Federation, registration and grant of the certificates of the Russian Federation;
  • arrangement of processing of the applications for appellations of origin, registration and grant of the certificates of the Russian Federation.

The terms of reference relating to the creation of the interactive forms for filing applications for computer programs, databases and topographies of integrated circuits were prepared and forwarded to the Ministry for Communications of the Russian Federation.

4.5. Use of Databases for the Purposes of Examination of Inventions and Utility Models

In 2012 there was no alternative to the processing of information searches in respect to applications in the electronic environment — according to the management decision the destruction of the part of paper examination funds containing foreign patent documentation for the last 20 years and being not complemented was started.

The Rospatent internal search system PartSerch, being installed on the working stations of all examiners, became the main searching instrument used during the examination process. The search array of the system of patent documentation of the Russian Federation and the former USSR, the CIS countries, DB DWPI, as well as arrays of the foreign patent documents included in the PCT minimum documentation. PatSerach allows performing searches of non-patent literature at the official site of Scientific Electronic Library RFFI and in the abstract database SCOPUS. Simultaneously, all examiners are provided for a free access to all search data bases of foreign patent offices.

4.5.1 On-line Search

At the present moment searches are mainly performed by the examiners in the online mode. If for any reasons the data provided in the PatSearch system is not enough for performing the examination, an additional patent information is usually received from the DB freely accessible via Internet, for example: Esp@cenet, DBs of the USPTO, JPO, DPMA DB DEPATISNET, WIPO PATENTSCOPE and the search system EAPATIS of the Eurasian Patent Office.

For acquiring of the data from the applications of the JPO and KIPO required in the course of the work under the РРН program, the examiners had access to the DBs AIPN and K-PION.

Among the number of free accessible DBs of non-patent literature, the examiners most frequently use from their working stations the databases on medicine and pharmacy PubMed of the USA National Library and abstract database SCOPUS.

If necessary, along with DBs freely available from all working stations, the examiners were provided for a possibility to carry out the searchers in commercial DBs. Most frequently they used patent and non-patent documentation databases available via the STN International network. As a rule, these databases are used for performing searches in the field of chemistry (REGISTRY, CA, BEILSTEIN, CASREACT, CHEMCATS and other).

Besides, according to the contract between FIPS and the European Patent Office (EPO), the FIPS examiners were provided from two working stations for the access to the EPO internal search system EPOQUE.

Access to the commercially available remote databases is provided for examiners in the specially equipped Online Access Room, where they can receive consultation and methodological assistance from qualified staff, who if necessary perform searches jointly with examiners. Examiners usually apply for this service in complicated cases, in particular where online information resources are required for the purposes of searches but not accessible from the examiners’ working stations or the qualification of an examiner is not sufficient for making searches in a particular database.

During 2012 there were conducted over 1200 searches in the Online Access Room. The majority of searches were performed in the DB REGISTRY and CA databases in the STN network.

For the purposes of improvement of information support of the examination, the available on-line DBs being useful for carrying out information searches were studied, as well as methodical guidance for examiners were prepared. In 2012 the search databases of such Asian countries as India, Philippines, Malaysia, Singapore, Taiwan and Hong Kong, as well as new DB of China were examined.

Both young and skilled examiners were provided for the training and consultations on using available DBs. First of all, the attention was paid to the Rospatent search system PatSearch and databases providing the information not contained in the PatSearch system.

4.5.2. Search of the Non-Patent Scientific and Technological Information

For the purpose of presenting searches of the non-patent scientific and technological literature, examiners are provided from their working stations for the access to the DBs «SCOPUS» and «E-library», to the websites of the libraries and specialized and polythematic databases in the field of medicine, biology, biotechnology, chemistry, pharmaceutics, to the search systems Google, Rambler, Yandex.

In order to expand the search range, examiners apply to the special search rooms where the access to the local DB, subject-matter DB on optical disks, patent and non-patent DB freely accessible via Internet and to the commercial DB VINITI.

The frequency of references to the various databases for searching scientific and technological literature in the «Training and Computer Search» Room(besides, the access form the working stations) is shown in Diagram 8 and Table 4.5.2.

The diagram shows that the DB VINITI is the most frequently used search resource in the «Training and Computer Search» Room (besides, the access form the working stations). It contains abstracts of foreign and national sources of scientific and technological literature. This DB is derived from the periodic and serial editions, books, dissertations, materials of the conferences, abstracts, patents, normative documents, deposited scientific works. Russian sources constitute 30% thereof.

4.5.3. Training on Use of Databases

In order to ensure the required quality of the work, training of the examiners on proper exploitation of various instruments for the information search is carried out permanently. The key staff of examiners, who have already studied the issues relating to the efficient methods of preparing the requests, searching and analyzing the documents found, works individually and does not need any education. In specific cases, when there are difficulties in performing the search or the system functions are updated, examiners refer to the search rooms. While the data bases and automated systems are updated, or new informational recourses appear, all the employees using them are invited to complete the training according to the Schedule of Education. As to the requests of the young examiners, or those having get back to work after a long-term interval or wishing to repeat the training, the education on using of the automated systems or electronic databases exciting, being already updated or recommended after the investigation of the Internet resources is conducted. Such an education was provided in 2012 as well. Moreover, all new examiners passed the compulsory education on the use of automated systems and electronic databases selected for examination search.

The groups of the examiners passing the training were formed on the basis of their background. Training was carried out according to the specially developed program, which provided for the qualification upgrading of the examiners with different background level and for their self-guided work with the electronic information resources using the knowledge gained.

4.5.4. Promotion of the Automated Text Translation System

During 2012 maintenance of the machine translation system PROMT was continued. The system was installed on 13 new working stations, and the functionality for the automated translation was updated. The employees actually using the system were invited to pass the training on the extended functions of its new version for the creation of the users’ dictionaries.

The efforts to extent the functionality for translation were made. Thematic users’ dictionaries were successfully integrated into the operating version of the system. The work relating to creation of the English-Russian users’ dictionaries on narrow examination topics was continued. After testing by the examiners, they will be integrated in the system for the wide use. Creation of the users’ dictionaries, as well as assimilation and exploitation of the system instruments, having effect on the quality of the translation, will be continued in the future, which should provide for the quality improvement in the translation of the patent documents.

4.6. Development of the Infrastructure

In the framework of the Program for Complex Modernization of Automated Systems of Rospatent, the following activities were performed in 2012:

  • Installation of the hardware-software complex for the modernization of the ISS PartSearch systems for indexing and searching being performed on the basis of VMware software. This complex provides for the dynamic digital power flow for the virtual servers, which ensures the required peak load efficiency.
  • Modernization of the disk storage facilities for the main software aimed at their dischargeable capacity extension by 50 Tb, which helped to ensure data mirroring on the various territorial areas and uploading of the additional patent documentation arrays in the systems Partsearch and TM-Admin for the search quality improvement. The size of the file system for the software applications of the ADB and AS “Electronic Achieve of Applications” was extended by 15 Tb.
  • Evolvement of the hardware-software complex for ensuring the possibility of the protected distal mode work of the trademark examiners.
  • Accreditation of the FIPS Certifying Centre on the basis of the Order of the Ministry for Communications of the Russian Federation № 252 of October 23, 2012 on the accreditation of the certifying centers.
  • Development of the architectural solutions for the transition to a new hardware platform of servers for the data bases of the main software applications.
