4.1. Program for Complex Modernization of Automated Systems

Within the framework of implementation of the Program for Complex Modernization of Automated Systems of Rospatent in 2010 the following activities were undertaken:

  • The filing of the entries signed by the electronic digital signatures of the executing officer into electronic State Register of Trademarks and Service Marks of the Russian Federation, State Register of Appellations of Origin of the Russian Federation and the electronic List of Well-Known Marks of the Russian Federation (hereinafter referred to as ESR) was continued. As of the end of December 2010, 37410 new registrations were filed in the ESR; 51315 registrations were transferred from the State Register maintained on paper.
  • The information search system PatSearch for examination of the inventions and utility models was put into operation for all working stations of the patent examiners.
  • Within the limits of performance of works on development of the automated librarian technological processes of the Automated Library System of the Patent Library of the FGU FIPS (ALS VPTB), in 2010 the FGU FIPS website users were provided with a remote access to the electronic catalogue “Legal Protection of the Intellectual Property, National and Foreign Publications from 1992 to the present time” via WWW-Gateway module. The mechanism of automatic statistics gathering in various sources was developed. The administrative procedures relating to automatic replication of 20 ALS VPTB software modules were worked out for distributing on the working stations of the users. The ALS VPTB software modules, namely Cataloger 57, Subscription, PUBL Cataloger, WWW-Gateway, Selector 51 were put into industrial operation.
  • The previously developed and put into industrial operation Uniform System of Fees Control (IES «Fees») which establishes the use of electronic payment documents received from the Federal Treasury was updated by means of providing the opportunity to account the fees for fulfillment of legal actions relating to examination of trademark applications and appellations of origin.
  • In the end of the year the automated system of electronic filing of applications for trademark registration and electronic interaction with the applicants is put into industrial operation. In the course of testing operation 250 trademark applications were filed. The system is intended for the creation of the applicant “cabinet” and processing the electronic document exchange between the applicant and the office, including materials of the applications as originally filed using electronic digital signature (EDS) and integrated into the hardware and software environment of the automated system of trademark paperless document processing “TM-ADMIN”. During the system development and promotion the problems of safe interaction of the web applications with the FGU FIPS local internal network were solved, as well as the problem of synchronization of data in the user cabinet and database TM-ADMIN and problem of quality control of information at data input and registration of the trademark application were settled. The use of the system is focused on processing of electronic documents, assumes decreasing terms of examination and cost of examination.
  • Global upgrading of hardware and software platform of the automated systems for the document processing of inventions and utility models (ADB and “Electronic Archive of the Applications”) caused by the expansion of the FGU FIPS administrative structure and change in the process of the examination of applications for the utility models was performed, which now provides for the examination of applications for the inventions and utility models in the examination divisions (previously the examination of applications for the utility models was carried out in a special department). Also the redistribution of the collections of applications to new divisions in compliance with the subject matter of the examination of applications was performed.
  • The upgrading of the automated system “Electronic Library of the РСТ Applications”, which provides for working out the receiving Office notifications according to the amended samples (about 40 notifications), expanding options for search in relation to the international applications and providing statistics on the PCT applications filed, was fulfilled. The data packages containing the PCT application materials were transferred in the test mode using the SFTP data exchange protocol.
  • The first stage of the automated system of paperless document processing of applications for inventions, the Subsystem for the Electronic Filing of the Applications for Inventions (AS EFAI I), was developed and put into testing operation. The subsystem provides for creating of the applicant’s personal “cabinet”, supporting him with the software for working out, correcting and transferring the application materials, signing of a package of the documents by EDS, as well as for electronic interaction with the applicant in the course of filing the applications. AS EFAI I is integrated into the FGU FIPS hardware and software environment together with the ADB automated systems and “Electronic Archive of the Applications”. The subsystem functions contain preparation and check of the documents and data of an application for the invention, signing of a package of the documents by EDS and sending thereof to the office, receiving documents of examination from the office, servicing the user “cabinet” and etc. During the development the subsystem was equipped with the data protection system counteracting an unauthorized access, hacking attempts and virus attacks by establishing the SSL VPN covert channel, which provides for the safe interaction between the external user (via Internet) and the internal network of the FGU FIPS. In the end of the year the development of the second stage of the system, the Subsystem for the Formal Examination of the Applications (AS SFEA II), was finished. This subsystem contains the software for automation of the formal examination processing including the full electronic interaction with the applicant via his personal “cabinet”. At the present moment the subsystem is tested. It is going to be put into testing operation in the end of the second quarter of 2011.
  • Preparation and adjustment of the FGU FIPS Data Processing Centre developed in 2009 on the basis of the ILAR software for putting it into testing operation in 2011 was carried out.

Information and Search System PatSearch for Examination of the Inventions and Utility Models

In 2010 the Information and Search System PatSearch for Inventions and Utility Models Examination (ISS) was put into operation for all working stations of the Rospatent patent examiners. PatSearch System is a professional information and search system for invention and utility model examination. In this connection this system has a wide set of functional and servicing possibilities.

In 2010 the main searching arrays of patent documentation of the PCT minimum countries, as well as a basic array of extended abstracts and bibliographic data of Dervent Co. (Thompson Reuter) DWPI were downloaded (40 million of documents). This array is the basic source of the search indexes. The arrays of patent documentation of the former USSR, Russia, the PCT, the EPO, the USA, Germany, England, France, Austria, Australia, ARIPO, OAPI, Korea. English-language abstracts and facsimile copies of Japanese documents were downloaded. In total, there are more than 20 billion of patent documents in original language. Access to the full descriptions of patent documents, which are not yet downloaded into the system, but found by the DWPI index, is provided for by the incorporated on-line query to the EPO arrays. The search for non-patent literature is realized by integrated request to the external digital library (E-Library) or to the world’s largest non-patent literature database SCOPUS. The major part of the arrays is represented by facsimile images of patent descriptions and required huge memory volume for their deployment – several tens of TB. Simultaneously, the task of ensuring required efficiency (up to 1000 users) and performance (5–10 seconds for standard search) on the full array of documentation was resolved. For this purpose the server and commutation equipment, processor modules and data repositories were purchased and the regular scheme of production calculating infrastructure was configured. The PatSearch system was transferred to the new advanced FAST Enterprise Search Platform, which allowed achieving the required productivity and performance.

Another important function of ISS is the possibility to use the automated translation of selected documents from foreign languages. The system also provides the possibility to control the quality of the examiner’s work while carrying out the information search.

Documentum – object-oriented means to store and manage large bulks of data, which provides for:

  • organization of working environment of the examiner (sessions, working book);
  • open data architecture (sources of data of patent documentation, and classifiers).

FAST EST – highly efficient advanced searching system, which provides for:

  • high efficiency;
  • flexible ways of building a query;
  • normalized indices;
  • scalability of the system.

ORACLE – highly efficient DBMS, which provides for:

  • high efficiency;
  • effective connection with data repository;
  • repository of metadata.

In order to ensure the efficient implementation of the systems to practice the two-stage training course for examiners on PatSearch, consisting of “Basic training” course and “Extended course” was developed and is widely used.

4.2. Exploitation of Internet Resources of Rospatent

During 2010 the access to the following resources was provided on the FGU FIPS Internet-site:

  • Information search system (ISS) of national patent documents;
  • Registers of Russian patent documents of all the types of industrial property;
  • Register of trademark applications, filed in 2005–2010, complemented by the proceeding data on the applications filed in 2008–2010;
  • Registers, containing information on processing the applications for patents, utility models and industrial designs filed in 2007–2010;
  • Official bulletins of Rospatent: “Inventions. Utility Models”, “Trademarks, Service Marks and Appellations of Origin”, “Industrial Designs”;
  • Daily published data on current registrations of trademarks, service marks, appellations of origin, well-known marks, and notifications of change of entries in the State Register of Trademarks;
  • Official Bulletin of Rospatent “Computer Programs, Databases, Topographies of Integrated Circuits”.

The Internet Resources of Rospatent include the following databases:

  • a full text database of Russian inventions (containing information on 417 thousand patents for inventions, covering the period from 1994 up to 2010), updated three times per month;
  • a backdating database of Russian patent documents presented in facsimile format (containing information on 1433 thousand patent documents for inventions covering the period from 1924 up to 1993);
  • an abstract database of Russian inventions (containing information on 432 thousand patents for inventions, covering the period from 1994 up to 2010), updated three times per month;
  • a database of published applications for inventions (containing information on 349 thousand applications, covering the period from 1994 up to 2010), updated three times per month;
  • database of abstracts in English to Russian inventions (containing information on 440 thousand patents, covering the period from 1994 up to 2010), updated three times per month;
  • a full-text database of Russian utility models (containing information on 101 thousand Russian certificates and patents for utility models, covering the period from 1996 up to 2010), quarterly updated;
  • an abstract database of Russian utility models (containing information on 101 thousand certificates and patents for utility models, covering the period from 1996 up to 2010), updated three times per month;
  • a database of Russian trademarks (containing information on 351 thousand Russian certificates for trademarks, covering the period from 1925 up to 2010), updated twice per month;
  • a database of International Trademarks Registrations with designation of Russian Federation (containing information on 211 thousand international registrations with designation of Russia, covering the time period from 1980 up to 2010), weekly updated – the access is provided for subscribers to the Trademarks databases;
  • “Prospective inventions” database;
  • a database “Appellations of Origin” — the access is provided for subscribers to the Trademarks databases;
  • a database “Well-known Russian marks”;
  • a database of industrial designs (containing information on 40.5 thousand patents for industrial designs, covering the time period from 1993 up to 2010), monthly updated;
  • a database of Russian trademark applications filed during 2005-2010 (containing information about 234 thousand applications), daily updated;
  • a database of applications for inventions filed in 2007-2010 (containing information about examination procedure on 163 thousand applications), daily updated;
  • a database of applications for utility models filed in 2007–2010 (containing information about examination procedure on 45 thousand applications), daily updated;
  • a data base of applications for industrial designs filed in 2007–2010 (containing information about examination procedure on 17 thousand applications), daily updated
  • International Patent Classification database (2010.01);

Use of the Information and Search System

Access for external users to the full text DB on inventions, utility models, trademarks and industrial designs is provided on a contract basis.

Within the framework of the Program on Regional Cooperation between Rospatent and the Regions of the Russian Federation, 147 organizations received free access to the full text databases of inventions.

Within the framework of agreements on cooperation between Rospatent and corresponding organizations the free access was provided:

  • to the full text databases of inventions – for 40 organizations participating in the implementation of the state project on the nanotechnology development;
  • to the databases of trademarks – for 20 organizations of the Federal Customs Service of the Russian Federation;
  • to all FGU FIPS databases:
  • to 85 organizations of the Federal Court Bailiffs Service of the Russian Federation;
  • to 169 organizations of the Ministry of Internal Affairs of the Russian Federation;
  • to 10 organizations of the Federal Antimonopoly Service of the Russian Federation.

External users are provided with free access to the following products:

In respect of inventions:

  • Abstract DBs in Russian and English;
  • DB of published applications for inventions;
  • DB “Prospective inventions;
  • Full text DB containing documents published in three recent Bulletins “Inventions. Utility Models”;
  • IPC DB,

In respect of utility models:

  • Full text DB containing documents published in three recent Bulletins “Inventions. Utility Models”;
  • IPC DB,

In respect of trademarks:

  • DB containing documents published in two recent Bulletins “Trademarks, Service Marks and Appellations of Origin”;
  • International Classification of Goods and Services DB.

During 2010 over 860 contracts providing access to commercially available databases of Rospatent were concluded. The total number of contracts concluded during the whole period of maintenance and use of the automated system of Rospatent amounted over 8500 contracts; by the end of 2010 about 6900 contracts were still valid.

During 2010 the number of search queries submitted by internal and external users to the ISS totaled over 4116 thousand, whereas:

  • over 552 thousand – by internal users of the databases;
  • over 3564 thousand – by external users of the databases.

The number of search sessions performed in the search system during 2010 amounted to 943 thousand, whereas:

  • by commercial users – over 153 thousand;
  • on free of charge basis – over 676 thousand;
  • by the Rospatent examiners – over 114 thousand.

Use of Registers of Russian Patent Documents

The users of Registers enjoy free access to all patent documents available in the Internet resources of Rospatent.

During 2010 the total number of queries submitted by internal and external users to the Registers exceeded 13 728 thousand, whereas:

  • about 298 thousand were entered by the internal users of the databases;
  • over 13 430 thousand were entered by the external users of the databases.

Use of Official Bulletins of Rospatent

Users enjoyed free access to the following Bulletins of Rospatent:

  • “Inventions. Utility Models” (three last published Bulletins);
  • “Trademarks. Service Marks. Appellations of Origin” (two last published Bulletins);
  • “Industrial Designs” (last published Bulletin) ;
  • “Computer programs, Databases. Topographies of Integrated Circuits (last published Bulletin).

During 2010 the total number of queries to electronic bulletins of Rospatent amounted to 1200 thousand.

4.3. Use of Databases for the Purposes of Examination of Inventions and Utility Models

In 2010 patent examiners were provided with an opportunity to carry out the information search in national and РСТ minimum documentation completely in electronic environment.

The basic resource of the information is the internal search system of Rospatent PatSearch installed on the working stations of all examiners. At the present moment the system contains arrays of patent documentation of Russian Federation, USSR, CIS countries, DB DWPI and of countries of the PCT minimum. The PatSearch system provides for non-patent literature search at the official site of Scientific Electronic Library RFFI and in the abstract database SCOPUS.

4.3.1. Online Search

At the present moment searches for the purposes of the examination of applications are mainly carried out in electronic databases accessible online. If for any reasons the data provided in PatSearch system is not enough for performing the examination, additional patent information is usually received from the DB, freely accessible via Internet, for example: Esp@cenet, DBs of the USPTO, JPO, DPMA DEPATISNET WIPO, search system of the Eurasian Patent Office (EAPATIS).

For data acquisition from the applications of the JPO and KIPO (under the program of the Patent Prosecution Highway, РРН) the examiners received access to the DBs AIPN and K-PION.

From the number of freely accessible DBs of non-patent literature, the examiners most frequently use from the working stations the databases on medicine and pharmacy of the USA National Library (PubMed) and abstract database SCOPUS.

If necessary, along with DBs freely available from all working stations, the examiners can perform searchers in commercially available DBs. Most frequently they use patent and non-patent documentation databases available via the STN International network. As a rule these databases are used for performing searches in the field of chemistry (REGISTRY, CA, BEILSTEIN, CASREACT, CHEMCATS and other). Besides DB STN International examiners have an access to the DB of Japan patent documents in English PATOLIS-e delivered by Questel company.

According to the contract between FGU FIPS and the European Patent Office (EPO) the FGU FIPS examiners since 2010 have been permitted to perform from several working stations searches on applications in the EPO internal search system EPOQUE.

Access for examiners to commercial databases is provided in specially equipped Online Access Room, where the examiners can receive consulting and methodological assistance from qualified staff, who if necessary perform searches jointly with examiners. Examiners usually apply for this service in complicated cases, in particular where online information resources are required for the purposes of searches but not accessible from the examiner’s working stations or the qualification of an examiner is not sufficient for making searches in a particular database.

During 2010 over 1400 complicated searches were conducted in the Online Access Room. Vast majority of them were performed in the STN-network databases, namely REGISTRY and CA.

For the purposes of improvement of information support of the examination, the available on-line DBs, which may be useful for carrying out information searches, are constantly studied and methodical guidance for examiners are prepared. In 2010 the recommendations for examiners related to performing the search in the DB DWIP contained in the PatSearch system were developed.

Constantly the training and providing consultations both to the young and skilled examiners on using available DBs is carried out. First of all the attention is paid to the Rospatent search system PatSearch and databases providing the information not contained in the PatSearch system.

4.3.2. Non-Patent Scientific and Technological Information Search

Examiners can perform search of the non-patent scientific and technological information both at their working stations and in the Online Access Room. The working stations are provided with an access to DB «SCOPUS» containing the foreign scientific and technological literature, to the websites of the libraries and to the specialized and polythematic databases in the field of medicine, biology, biotechnology, chemistry, pharmaceutics. One computer in each examiners’ room provides an access to the search systems Google, Rambler, Yandex. In case the above resources are insufficient for examiners, they apply to the special search rooms where the access to the local DB, subject-matter DB on optical disks, patent and non-patent DB freely accessible via Internet and to the commercial DB VINITI.

The frequency of addresses to various databases in the «Training and Computer Search» Room is shown in Table 4.3.2.

The above scheme shows that, as a rule, the patent examiners address to the DB VINITI, which contains abstracts of foreign and national sources of scientific and technological literature. The DB is derived from the periodic and serial editions, books, dissertations, materials of the conferences, abstracts, patents, normative documents, deposited scientific works. Russian sources constitute 30% thereof.

4.3.3. Training on Use of Databases

In order to ensure the required quality production training of examiners on various topics relating to the information search is carried out permanently. In 2010 the training of examiners on use of electronic systems and databases intended for performing information search, both traditionally used but regularly updated and newly recommended after study of the Internet resources, was continued. All new examiners passed the compulsory education on the use of electronic systems and databases selected for examination search. Table 4.3.3 reflects the statistics relating to the training of examiners.

The groups of examiners undergoing the training were formed on the basis of their background. Training was carried out according to the specially developed program, which provided for the qualification upgrading of the examiners with different background level and for their self-guided work with the electronic information resources using the knowledge gained.

4.3.4. Promotion of the Automated Text Translation System


During 2010 the PROMT machine translation system was updated. New version provides for the translation of 5-way documents in different formats: information from the websites, e-mail communications, presentations and package transfer. Translation of documents is carried out in the professional environment with a wide set of functions of adjustment focused on the subject of the text, as well as with the simplified process of adjustment, which provides for translation quality improvement. The client-end portion was installed in the automated mode on the all working stations in the examination and several other divisions.

Thematic user dictionaries created in the PROMT previous version were successfully integrated into the operating one. For several narrow examination topics there have been created new English-Russian user dictionaries that after their testing by examiners will be included in the system for wide use. Development of user dictionaries on various examination topics and their inclusion in the PROMT system will continue. That should provide for the quality improvement of the translation of foreign patent documents analyzed in the course of examination.
